Hadith 1315
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ: أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا أَلْبَتَّةَ وَهُوَ غَائِبٌ بِالشَّامِ فَذَكَرَ الْحَدِيثَ، وَقَالَ فِيهِ: فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ: لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ، وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ، ثُمَّ قَالَ: تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ، فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ.
It is narrated from Fatimah bint Qais (may Allah be pleased with her) that Abu Amr bin Hafs gave her an irrevocable divorce (the third and final divorce) while he was in Syria. Then a long hadith is mentioned, and in it she said that she came to the Messenger of Allah (peace and blessings be upon him) and mentioned this to him. The Prophet (peace and blessings be upon him) said: "You are not entitled to maintenance from him." And he ordered her to spend her waiting period ('iddah) in the house of Umm Sharik. Then he said: "She is a woman whom my companions frequently visit, so spend your 'iddah in the house of Ibn Umm Maktum. He is a blind man, so you may remove your clothes (i.e., relax your hijab) there."

Hadith 1316
أَخْبَرَنَا إِبْرَاهِيمُ بْنُ أَبِي يَحْيَى، عَنْ عَمْرِو بْنِ مَيْمُونِ بْنِ مِهْرَانَ، عَنْ أَبِيهِ، قَالَ: قَدِمْتُ الْمَدِينَةَ فَسَأَلْتُ عَنْ أَعْلَمِ أَهْلِهَا، فَدَفَعْتُ إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ، فَسَأَلْتُهُ عَنِ الْمَبْتُوتَةِ، فَقَالَ: تَعْتَدُّ فِي بَيْتِ زَوْجِهَا. فَقُلْتُ: فَأَيْنَ حَدِيثُ فَاطِمَةَ بِنْتِ قَيْسٍ؟ فَقَالَ: هَاهْ وَوَصَفَ أَنَّهُ تَغَيَّظَ، وَقَالَ: قَتَلَتْ فَاطِمَةُ النَّاسَ وَكَانَ لِلِسَانِهَا ذَرَابَةٌ فَاسْتَطَالَتْ عَلَى أَحْمَائِهَا فَأَمَرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ مَكْتُومٍ.
Maymun bin Mehran says: I came to Madinah and asked about the greatest scholar of Madinah, so I was sent to Sa'id bin al-Musayyib (may Allah be pleased with him). I asked him about a woman who has been given an irrevocable divorce, and he replied: She will observe her 'iddah in her husband's house. So I said, "What about the hadith of Fatimah bint Qais?" He expressed anger and said: The incident of Fatimah has ruined people, although there was harshness in her speech, which was unpleasant for her husband's relatives, so the Messenger of Allah (peace and blessings be upon him) ordered her to observe her 'iddah in the house of Umm Maktum.

Hadith 1317
أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ وَسُلَيْمَانَ: أَنَّهُ سَمِعَهُمَا يَذْكُرَانِ: أَنَّ يَحْيَى بْنَ سَعِيدِ بْنِ الْعَاصِ طَلَّقَ بِنْتَ عَبْدِ الرَّحْمَنِ بْنِ الْحَكَمِ أَلْبَتَّةَ، فَانْتَقَلَهَا عَبْدُ الرَّحْمَنِ بْنُ الْحَكَمِ، فَأَرْسَلَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا إِلَى مَرْوَانَ بْنِ الْحَكَمِ وَهُوَ أَمِيرُ الْمَدِينَةِ، فَقَالَتْ: اتَّقِ اللَّهَ يَا مَرْوَانُ، وَارْدُدِ الْمَرْأَةَ إِلَى بَيْتِهَا. فَقَالَ مَرْوَانُ فِي حَدِيثِ سُلَيْمَانَ: إِنَّ [ ص: 133 ] عَبْدَ الرَّحْمَنِ غَلَبَنِي. وَقَالَ مَرْوَانُ فِي حَدِيثِ الْقَاسِمِ: أَوَمَا بَلَغَكِ شَأْنُ فَاطِمَةَ بِنْتِ قَيْسٍ؟ فَقَالَتْ: لَا عَلَيْكَ أَنْ لَا تَذْكُرَ شَأْنَ فَاطِمَةَ. فَقَالَ: إِنْ كَانَ إِنَّمَا بِكِ الشَّرُّ فَحَسْبُكِ مَا بَيْنَ هَذَيْنِ مِنَ الشَّرِّ.
It is narrated from Qasim and Sulaiman bin Yasar, both state that Yahya bin Saeed bin As sent an irrevocable divorce to the daughter of Abdur Rahman bin Hakam, so Abdur Rahman bin Hakam brought her from her husband's house. When Aisha (may Allah be pleased with her) learned of this, she sent a message to the governor of Madinah, Marwan bin Hakam, and said, "O Marwan, fear Allah and return the woman to her (husband's) house." In the narration of Sulaiman, it is mentioned that Marwan said: "Abdur Rahman prevailed over me (i.e., he did not accept my word)." And in the narration of Qasim, Marwan replied: "Do you not know about the case of Fatimah bint Qais?" Upon this, Aisha (may Allah be pleased with her) said: "Even if you had not mentioned the incident of Fatimah, you would still have no right (because that is not evidence for you)." In response, Marwan said: "If Fatimah's moving from her husband's house was due to tension among the husband's relatives, then that situation is also present here." (i.e., there is also tension among them).

Hadith 1318
أَخْبَرَنَا عَبْدُ الْعَزِيزِ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ أَنَّ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا كَانَتْ تَقُولُ: اتَّقِ اللَّهَ يَا فَاطِمَةُ فَقَدْ عَلِمْتِ فِي أَيِّ شَيْءٍ كَانَ ذَلِكَ.
It is narrated from Muhammad bin Ibrahim that Aisha (may Allah be pleased with her) used to say, "O Fatimah! Fear Allah. Do you know why this command was given? (That is, to spend the waiting period in the house of Ibn Umm Maktum instead of the husband's house.)"

Hadith 1319
أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ الدَّرَاوَرْدِيُّ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ بْنِ الْحَارِثِ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ فِي قَوْلِ اللَّهِ تَعَالَى: إِلا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ [الطَّلَاقِ: 1] قَالَ: أَنْ تَبْدُوَ عَلَى أَهْلِ زَوْجِهَا فَإِذَا بَدَتْ فَقَدْ حَلَّ إِخْرَاجُهَا. أَخْرَجَ الْأَرْبَعَةَ الْأَحَادِيثَ مِنْ كِتَابِ الْعِدَدِ، وَالْخَامِسَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ.
It is narrated from Ibn Abbas (may Allah be pleased with him) regarding the statement of Allah Almighty, "except in case they commit a clear indecency" (__QUR_N__: At-Talaq: 1), he said: If her indecency becomes evident to her family, then it is permissible to send her out of the house.
