Hadith 1305
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ أَخْبَرَهُ، أَنَّ رَجُلًا مِنَ الْأَنْصَارِ، يُقَالُ لَهُ: حَبَّانُ بْنُ مُنْقِذٍ طَلَّقَ امْرَأَتَهُ وَهُوَ صَحِيحٌ، وَهِيَ تُرْضِعُ ابْنَتَهُ فَمَكَثَتْ سَبْعَةَ عَشَرَ شَهْرًا لَا تَحِيضُ، يَمْنَعُهَا الرَّضَاعُ أَنْ تَحِيضَ ثُمَّ مَرِضَ حَبَّانُ بَعْدَ أَنْ طَلَّقَهَا بِسَبْعَةِ أَشْهُرٍ أَوْ ثَمَانِيَةِ أَشْهُرٍ، فَقُلْتُ لَهُ: إِنَّ امْرَأَتَكَ تُرِيدُ أَنْ تَرِثَ. فَقَالَ لِأَهْلِهِ: احْمِلُونِي إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ، فَحَمَلُوهُ إِلَيْهِ، فَذَكَرَ لَهُ شَأْنَ امْرَأَتِهِ وَعِنْدَهُ عَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ وَزَيْدُ بْنُ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ لَهُمَا عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ: مَا تَرَيَانِ؟ فَقَالَا: نَرَى أَنَّهَا تَرِثُهُ إِنْ مَاتَ، وَيَرِثُهَا إِنْ مَاتَتْ، فَإِنَّهَا لَيْسَتْ مِنَ الْقَوَاعِدِ اللَّاتِي قَدْ يَئِسْنَ مِنَ الْمَحِيضِ، وَلَيْسَتْ مِنَ الْأَبْكَارِ الَّلَاتِي لَمْ يَبْلُغْنَ الْمَحِيضَ، ثُمَّ هِيَ عَلَى عِدَّةِ حَيْضِهَا مَا كَانَ مِنْ قَلِيلٍ أَوْ كَثِيرٍ، فَرَجَعَ حَبَّانُ إِلَى أَهْلِهِ وَأَخَذَ ابْنَتَهُ، فَلَمَّا فَقَدَتِ الرَّضَاعَ حَاضَتْ حَيْضَةً ثُمَّ حَاضَتْ حَيْضَةً أُخْرَى ثُمَّ تُوُفِّيَ حَبَّانُ قَبْلَ أَنْ تَحِيضَ الثَّالِثَةَ، فَاعْتَدَّتْ عِدَّةَ الْمُتَوَفَّى عَنْهَا وَوَرِثَتْهُ. قَالَ: فِي كِتَابٍ فِي حَبَّانَ بْنِ مُنْقِذٍ بِالْبَاءِ.
Abdur Rahman bin Abi Bakr narrated that Hibban bin Munqidh Al-Ansari divorced his wife while he was healthy, and that woman was breastfeeding their daughter. Seventeen months passed and she did not menstruate; due to breastfeeding, she was not getting her period. Then, seventeen or eighteen months after the divorce, Hibban became ill. I said to him: "Your wife wants to become your heir." He said to his family: "Take me to Uthman (may Allah be pleased with him)." They took him to him, and he informed him about his wife's intention. Ali bin Abi Talib (may Allah be pleased with him) and Zaid bin Thabit (may Allah be pleased with him) were also present with Uthman (may Allah be pleased with him). Uthman (may Allah be pleased with him) said to them: "What do you both think?" They both said: "In our opinion, if he dies, the woman will inherit from him, and if she dies, he will inherit from her, because she is neither among those women whose menstruation has stopped, nor among those girls who have not yet reached the age of menstruation. Therefore, she is in her waiting period for menstruation." (Upon hearing this) Hibban returned home and took his daughter from her. When the breastfeeding stopped, she had one period, then a second period, and before she could have a third period, Hibban passed away. So she observed the waiting period for a woman whose husband has died and also inherited from his wealth.
Hadith 1306
أَخْبَرَنَا مَالِكٌ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ: أَنَّهُ كَانَ عِنْدَ جَدِّهِ هَاشِمِيَّةٌ وَأَنْصَارِيَّةٌ، فَطَلَّقَ الْأَنْصَارِيَّةَ وَهِيَ تُرْضِعُ فَمَرَّتْ بِهَا سَنَةٌ، ثُمَّ هَلَكَ وَلَمْ تَحِضْ. فَقَالَتْ: أَنَا أَرِثُهُ لَمْ أَحِضْ، فَاخْتَصَمُوا إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ، فَقَضَى لِلْأَنْصَارِيَّةِ بِالْمِيرَاثِ، فَلَامَتِ الْهَاشِمِيَّةُ عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: هَذَا عَمَلُ ابْنِ عَمِّكِ، هُوَ أَشَارَ عَلَيْنَا بِهَذَا، يَعْنِي: عَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْعِدَدِ.
It is narrated from Muhammad bin Yahya bin Haban that his grandfather had a Hashemite and an Ansari woman in his marriage. He divorced the Ansari woman while she was breastfeeding, and a year passed in which he died and the woman did not menstruate. The woman said: "I will inherit from him because I have not menstruated." They brought their dispute to Uthman (may Allah be pleased with him), and he ruled in favor of inheritance for the Ansari woman. Upon this, the Hashemite woman spoke ill of Uthman (may Allah be pleased with him), so he said: "This is the work of your cousin," referring to Ali bin Abi Talib (may Allah be pleased with him).
