Hadith 1298
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ وَسُلَيْمَانَ بْنِ يَسَارٍ: أَنَّ طُلَيْحَةَ كَانَتْ تَحْتَ رُشَيْدٍ الثَّقَفِيِّ فَطَلَّقَهَا أَلْبَتَّةَ، فَنَكَحَتْ فِي عِدَّتِهَا. فَضَرَبَهَا عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ وَضَرَبَ زَوْجَهَا بِالْمِخْفَقَةِ ضَرَبَاتٍ، وَفَرَّقَ بَيْنَهُمَا، ثُمَّ قَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: أَيُّمَا امْرَأَةٍ نَكَحَتْ فِي عِدَّتِهَا، فَإِنْ كَانَ زَوْجُهَا الَّذِي تَزَوَّجَهَا لَمْ يَدْخُلْ بِهَا، فُرِّقَ بَيْنَهُمَا، ثُمَّ اعْتَدَّتْ بَقِيَّةَ عِدَّتِهَا مِنْ زَوْجِهَا الْأَوَّلِ، وَكَانَ خَاطِبًا مِنَ الْخُطَّابِ، وَإِنْ كَانَ دَخَلَ بِهَا فُرِّقَ بَيْنَهُمَا ثُمَّ اعْتَدَّتْ بَقِيَّةَ عِدَّتِهَا مِنَ الْأَوَّلِ، ثُمَّ اعْتَدَّتْ مِنَ الْآخَرِ ثُمَّ لَمْ يَنْكِحْهَا أَبَدًا. [ ص: 122 ] قَالَ سَعِيدٌ: وَلَهَا مَهْرُهَا بِمَا اسْتَحَلَّ مِنْهَا.
It is narrated from Ibn Musayyib and Sulayman bin Yasar that Talihah was married to Rashid Thaqafi. Her husband gave her an irrevocable divorce, and then during her waiting period (‘iddah), she married another man. So ‘Umar bin Khattab (may Allah be pleased with him) flogged her and her second husband and separated them. Then ‘Umar bin Khattab (may Allah be pleased with him) said: “Any woman who marries during her ‘iddah, if her (new) husband has not consummated the marriage with her, then they will be separated, and she will complete the remaining ‘iddah from her first husband, and this (second husband) will be counted as one of those who sent a marriage proposal. If they have consummated the marriage, then they will also be separated, and this woman will observe the waiting period (‘iddah) for both her first and second husband, and she can never marry the (second) husband again.” Sa‘id said: Due to consummation, the woman will also be entitled to the dowry.

Hadith 1299
أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، عَنْ جَرِيرٍ، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ زَاذَانَ أَبِي عُمَرَ، عَنْ عَلِيٍّ، أَنَّهُ قَضَى فِي الَّتِي تَزَوَّجُ فِي عِدَّتِهَا أَنْ يُفَرَّقَ بَيْنَهُمَا، وَلَهَا الصَّدَاقُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا، وَتُكْمِلُ مَا أَفْسَدَتْ مِنْ عِدَّةٍ، وَتَعْتَدُّ مِنَ الْآخَرِ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْعِدَدِ.
It is narrated from Ali (may Allah be pleased with him) that he gave the verdict regarding a woman who married during her waiting period (iddah) that the two should be separated (i.e., the marriage should be annulled), and due to having relations with the woman, she is entitled to her dowry (mahr). The waiting period (iddah) which the woman disrupted, she must complete, and she must also observe the waiting period for the second husband.
