Hadith 1285
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَمْرٍو، عَنْ عَبْدِ الْكَرِيمِ بْنِ مَالِكٍ الْجَزَرِيِّ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ، فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يُشْهِدُ عَلَى رَجْعَتِهَا وَلَمْ تَعْلَمْ بِذَلِكَ، قَالَ: هِيَ امْرَأَةُ الْأَوَّلِ دَخَلَ بِهَا الْآخَرُ أَوْ لَمْ يَدْخُلْ. أَخْرَجَهُ مِنْ كِتَابِ الرَّجْعَةِ.
It is narrated from Ali (may Allah be pleased with him) regarding the man who, after divorcing his wife, appointed someone as a witness to his taking her back, while his wife was not aware of it. He said: This woman belongs to the first husband, whether the second has had intercourse with her or not.
