Hadith 1238
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فِي زَمَانِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. قَالَ عُمَرُ: فَسَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ: "مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ فَإِنْ شَاءَ أَمْسَكَهَا [ ص: 95 ] وَإِنْ شَاءَ طَلَّقَهَا قَبْلَ أَنْ يَمَسَّ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ" .
It is narrated from Ibn Umar (may Allah be pleased with them both) that he divorced his wife during the time of the Messenger of Allah (ﷺ) while she was menstruating. Umar (may Allah be pleased with him) said: I asked the Messenger of Allah (ﷺ) about this, so he (ﷺ) said: "Tell Ibn Umar to take his wife back, then keep her in his marriage until she becomes pure from her menstruation. Then she should menstruate again and then become pure. Then, if he wishes, he may keep his wife in marriage, and if he wishes, he may divorce her before having intercourse with her. This is the prescribed period of purity in which Allah has commanded the women to be divorced."

Hadith 1239
أَخْبَرَنَا مُسْلِمٌ، وَسَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنِي أَبُو الزُّبَيْرِ: أَنَّهُ سَمِعَ عَبْدَ الرَّحْمَنِ بْنَ أَيْمَنَ مَوْلَى عَزَّةَ يَسْأَلُ عَبْدَ اللَّهِ بْنَ عُمَرَ وَأَبُو الزُّبَيْرِ يَسْمَعُ. فَقَالَ: كَيْفَ تَرَى فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ حَائِضًا؟ فَقَالَ ابْنُ عُمَرَ: طَلَّقَ عَبْدُ اللَّهِ بْنُ عُمَرَ امْرَأَتَهُ حَائِضًا، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مُرْهُ فَلْيُرَاجِعْهَا، فَإِذَا طَهُرَتْ، فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ" . قَالَ ابْنُ عُمَرَ قَالَ اللَّهُ عَزَّ وَجَلَّ: يَأَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهَنَّ فِي قُبُلِ عِدَّتِهِنَّ أَوْ لِقُبُلِ عِدَّتِهِنَّ. الشَّافِعِيُّ شَكَّ.
Abu Zubair narrated that Abdur Rahman bin Aiman, the freed slave of Azza, was asking Abdullah bin Umar (may Allah be pleased with them both), and Abu Zubair was listening. He asked: "What is your opinion about a man who divorces his wife while she is menstruating?" Ibn Umar (may Allah be pleased with them both) replied that Abdullah bin Umar (i.e., he himself) had divorced his wife during her menstruation, so the Prophet (ﷺ) said: "Tell him (Ibn Umar) to take his wife back, and when she becomes pure from her menstruation, then if he wishes, he may divorce her or keep her in marriage." Ibn Umar (may Allah be pleased with them both) said, Allah the Exalted has said: "O Prophet! When you divorce women, divorce them at the commencement of their waiting period." Imam Shafi'i (may Allah have mercy on him) was uncertain in «في قُبل عدتهن» and «لقبل عدتهن».

Hadith 1240
أَخْبَرَنَا مُسْلِمٌ وَسَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ مُجَاهِدٍ أَنَّهُ كَانَ يَقْرَؤُهَا كَذَلِكَ.
It is narrated from Mujahid (may Allah have mercy on him) that he also used to recite «فطلقوهن لعدتهن» as «في قبل عدتهن».

Hadith 1241
أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ: أَنَّهُ كَانَ يَقْرَؤُهَا: إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِقُبُلِ عِدَّتِهِنَّ.
It is narrated from Abdullah bin Umar (may Allah be pleased with them both) that he used to recite in this manner: «اذا طلقتم النساء فطلقوهن لقبل عدتهن».

Hadith 1242
أَخْبَرَنَا عَبْدُ الْمَجِيدِ بْنُ عَبْدِ الْعَزِيزِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنِي أَبُو الزُّبَيْرِ: أَنَّهُ سَمِعَ عَبْدَ اللَّهِ بْنَ أَيْمَنَ يَسْأَلُ ابْنَ عُمَرَ، وَأَبُو الزُّبَيْرِ يَسْمَعُ: كَيْفَ تَرَى فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ حَائِضًا؟ فَقَالَ: طَلَّقَ عَبْدُ اللَّهِ بْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَ عُمَرُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مُرْهُ فَلْيُرَاجِعْهَا" ، فَرَدَّهَا عَلَيَّ وَلَمْ يَرَهَا شَيْئًا فَقَالَ: "إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ" .
Abu Zubair narrated that he heard Abdullah bin Ayman asking Ibn Umar (may Allah be pleased with them both), and Abu Zubair was listening: "What is your opinion about a man who divorces his wife while she is menstruating?" He replied that during the time of the Prophet ﷺ, Abdullah bin Umar (may Allah be pleased with them both) divorced his wife while she was menstruating. When Umar (may Allah be pleased with him) asked the Messenger of Allah ﷺ about this, the Messenger of Allah ﷺ said: "Tell Ibn Umar to take her back." She was returned to me and it was not considered a problem, and he said: "When she becomes pure from her menstruation, then if you wish, divorce her or keep her in marriage."

Hadith 1243
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فِي عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَ عُمَرُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مُرْهُ فَلْيُرَاجِعْهَا" ، فَرَدَّهَا عَلَيَّ وَلَمْ يَرَهَا شَيْئًا، فَقَالَ: "إِذَا هِيَ طَهُرَتْ فَلْيُطَلِّقْ أَوْ لِيُمْسِكْ" .
It is narrated from Ibn Umar (may Allah be pleased with them both) that he divorced his wife during her menstruation in the time of the Prophet ﷺ. When Umar (may Allah be pleased with him) asked the Messenger of Allah ﷺ about this, the Messenger of Allah ﷺ said: "Order Ibn Umar to take her back." The Prophet ﷺ returned the woman to me without any objection, and said: "When she becomes pure from her menstruation, then he may divorce her or keep her in his marriage."

Hadith 1244
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فِي عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَ عُمَرُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ عَزَّ وَجَلَّ أَنْ يُطَلَّقَ لَهَا النِّسَاءَ" .
It is narrated from Ibn Umar (may Allah be pleased with them both) that he divorced his wife during her menstrual period in the time of the Prophet ﷺ. When Umar (may Allah be pleased with him) asked the Messenger of Allah ﷺ about this, the Messenger of Allah ﷺ said: "Tell Ibn Umar to take her back, then keep her with him until she becomes pure from her menstruation, then she has her menses again, and when she becomes pure after that, if he wishes, he may keep her in his marriage, and if he wishes, he may divorce her before having intercourse with her in that period of purity. This is the waiting period in which Allah has commanded women to be divorced."

Hadith 1245
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ: أَنَّهُمْ أَرْسَلُوا إِلَى نَافِعٍ يَسْأَلُونَهُ: هَلْ حَسَبْتَ تَطْلِيقَةَ ابْنِ عُمَرَ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. قَالَ: نَعَمْ. [ ص: 97 ] أَخْرَجَ الْأَرْبَعَةَ الْأَحَادِيثَ مِنْ كِتَابِ إِبَاحَةِ الطَّلَاقِ وَإِلَى آخِرِ الثَّامِنِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ.
It is narrated from Ibn Jurayj that he sent a man to Nafi‘ (may Allah have mercy on him) to ask whether, in the time of the Prophet ﷺ, the divorce given by Ibn ‘Umar (may Allah be pleased with him) was counted. He replied: "Yes."
