Hadith 1232
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرَةَ أَخْبَرَتْهُ: أَنَّ حَبِيبَةَ بِنْتَ سَهْلٍ أَخْبَرَتْهَا: أَنَّهَا كَانَتْ عِنْدَ ثَابِتِ بْنِ قَيْسِ بْنِ شَمَّاسٍ وَأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ إِلَى صَلَاةِ الصُّبْحِ، فَوَجَدَ حَبِيبَةَ بِنْتَ سَهْلٍ عِنْدَ بَابِهِ فِي الْغَلَسِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مَنْ هَذِهِ" ؟ فَقَالَتْ: أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ [ ص: 91 ] يَا رَسُولَ اللَّهِ، فَقَالَ: "مَا شَأْنُكِ" ؟ قَالَتْ: لَا أَنَا وَلَا ثَابِتٌ لِزَوْجِهَا، فَلَمَّا جَاءَ ثَابِتُ بْنُ قَيْسٍ قَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "هَذِهِ حَبِيبَةُ بِنْتُ سَهْلٍ، قَدْ ذَكَرَتْ مَا شَاءَ اللَّهُ أَنْ تَذْكُرَ" . فَقَالَتْ حَبِيبَةُ: يَا رَسُولَ اللَّهِ، كُلُّ مَا أَعْطَانِي عِنْدِي. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "خُذْ مِنْهَا" فَأَخَذَ مِنْهَا وَجَلَسَتْ فِي أَهْلِهَا.
It is narrated from Umrah that she informed that Habibah bint Sahl (may Allah be pleased with her) told her that she was married to Thabit bin Qais bin Shamas. And when the Messenger of Allah ﷺ went out for the morning prayer, he found Habibah bint Sahl at his door in the darkness. The Messenger of Allah ﷺ, upon seeing her, asked: "Who is this?" She said: "I am Habibah bint Sahl, O Messenger of Allah!" He ﷺ asked: "What troubles you?" She said: "I and Thabit cannot live together." Then when Thabit bin Qais (may Allah be pleased with him) came, the Messenger of Allah ﷺ said to him: "This is Habibah bint Sahl, regarding whom Allah has willed, you have spoken." Habibah said: "O Messenger of Allah ﷺ! Whatever he gave me (as dowry) is with me." So the Messenger of Allah ﷺ said to Thabit: "Take (the dowry) from her." He took it back, and Habibah (may Allah be pleased with her) returned to her family after obtaining khul‘.
Hadith 1233
أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرَةَ، عَنْ حَبِيبَةَ بِنْتِ سَهْلٍ: أَنَّهَا أَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْغَلَسِ وَهِيَ تَشْكُو شَيْئًا بِيَدَيْهَا وَهِيَ تَقُولُ: لَا أَنَا وَلَا ثَابِتُ بْنُ قَيْسٍ، فَقَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "يَا ثَابِتُ خُذْ مِنْهَا" . فَأَخَذَ مِنْهَا وَجَلَسَتْ.
It is narrated from Habibah bint Sahl (may Allah be pleased with her) that she came to the Prophet (ﷺ) in the dark, and complained with her hands about something, saying: "I and Thabit bin Qais (may Allah be pleased with him) cannot live together." Habibah says: The Messenger of Allah (ﷺ) said to Thabit: "O Thabit, take back the dowry you gave her." He took back the dowry, and she sat after obtaining khul‘ (divorce).
Hadith 1234
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ مَوْلَاةٍ لِصَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا بِكُلِّ شَيْءٍ لَهَا، فَلَمْ يُنْكِرْ ذَلِكَ عَبْدُ اللَّهِ بْنُ عُمَرَ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْخُلْعِ وَالنُّشُوزِ، وَالثَّالِثَ مِنْ كِتَابِ الْأَشْرِبَةِ.
Nafi' narrated regarding the freed slave woman of Safiyyah bint Abi Ubayd that she obtained khul' from her husband by giving him everything she had, and Abdullah bin Umar (may Allah be pleased with them both) did not object to this.
