Hadith 1147
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا، وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا، وَإِذْنُهَا صُمَاتُهَا" .
It is narrated from Abdullah bin Abbas (may Allah be pleased with them) that the Messenger of Allah (peace be upon him) said: "A widow has more right over herself than her guardian, and a virgin should be asked for permission regarding her marriage, and her permission is her silence."
Hadith 1148
أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا، وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا، وَإِذْنُهَا صُمَاتُهَا" . أَخْرَجَ الْأَوَّلَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ، وَالثَّانِيَ مِنْ كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ.
It is narrated from Ibn Abbas (may Allah be pleased with them) that the Prophet (ﷺ) said: "A widow has more right over herself than her guardian, and a virgin should be asked for permission regarding her marriage, and her silence is her permission."
