Hadith 1133
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمٌ، عَنِ ابْنِ خُثَيْمٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّ مُرْشِدٍ وَشَاهِدَيْ عَدْلٍ.
It is narrated from Ibn Abbas (may Allah be pleased with them) that he said: A marriage does not take place without a guardian, a wali, and two trustworthy witnesses.
Hadith 1134
أَخْبَرَنَا مُسْلِمٌ وَسَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُثْمَانَ بْنِ خُثَيْمٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، وَمُجَاهِدٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشَاهِدَيْ عَدْلٍ وَوَلِيٍّ مُرْشِدٍ، وَأَحْسَبُ مُسْلِمًا قَدْ سَمِعَهُ مِنَ ابْنِ خُثَيْمٍ. أَخْرَجَ الْأَوَّلَ فِي كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ، وَالثَّانِيَ مِنْ كِتَابِ عِشْرَةِ النِّسَاءِ.
It is narrated from Ibn Abbas (may Allah be pleased with them) that he stated: A marriage does not take place without a guardian, two trustworthy witnesses, and a guiding guardian, and in my opinion, Muslim heard this from Ibn Khuthaym.
