بَابُ لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ

Hadith 1125
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ [ ص: 37 ] ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "لَا يَخْطُبْ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ" .
It is narrated from Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace be upon him) said: "None of you should send a marriage proposal over the proposal of his brother."
Hadith 1126
أَخْبَرَنَا مَالِكٌ، عَنْ أَبِي الزِّنَادِ، عَنِ الْأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ. وَقَدْ زَادَ بَعْضُ الْمُحَدِّثِينَ: "حَتَّى يَأْذَنَ أَوْ يَتْرُكَ" .
It is narrated from Abu Huraira (may Allah be pleased with him) from the Prophet Muhammad (peace and blessings be upon him) similar to the previous hadith. And some hadith scholars have added these words: "until he seeks permission from him or he breaks off the engagement."
Hadith 1127
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "لَا يَخْطُبْ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ" .
It is narrated from Ibn Umar (may Allah be pleased with them) that the Messenger of Allah (peace and blessings be upon him) said: "None of you should propose to a woman to whom his brother has already proposed."
Hadith 1128
أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، قَالَ: أَخْبَرَنِي ابْنُ الْمُسَيِّبِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا يَخْطُبْ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ" .
It is narrated from Abu Huraira (may Allah be pleased with him) that he stated: The Messenger of Allah (peace and blessings be upon him) said: "None of you should propose marriage over the proposal of his brother."
Hadith 1129
أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنْ مُسْلِمٍ الْخَيَّاطِ، عَنِ ابْنِ عُمَرَ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى أَنْ يَخْطُبَ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَنْكِحَ أَوْ يَتْرُكَ. أَخْرَجَ الْحَدِيثَيْنِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ، وَالثَّالِثَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ، وَالرَّابِعَ وَالْخَامِسَ مِنْ كِتَابِ التَّعْرِيضِ بِالْخِطْبَةِ.
It is narrated from Ibn Umar (may Allah be pleased with them both) that the Prophet (ﷺ) forbade a man from proposing to a woman to whom his brother has already proposed, until he marries her or leaves her (i.e., breaks off the engagement).
