Hadith 1120
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ وَسَعِيدٌ، عَنِ ابْنِ [ ص: 35 ] جُرَيْجٍ، عَنْ عِكْرِمَةَ بْنِ خَالِدٍ: أَنَّ ابْنَ أُمِّ الْحَكَمِ سَأَلَ امْرَأَةً لَهُ أَنْ يُخْرِجَهَا مِنْ مِيرَاثِهَا مِنْهُ فِي مَرَضِهِ فَأَبَتْ فَقَالَ: لَأُدْخِلَنَّ عَلَيْكِ فِيهِ مَنْ يُنْقِصُ حَقَّكِ أَوْ يَضُرُّ بِهِ فَنَكَحَ ثَلَاثًا فِي مَرَضِهِ أَصْدَقَ كُلَّ وَاحِدَةٍ مِنْهُنَّ أَلْفَ دِينَارٍ، فَأَجَازَ ذَلِكَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ. قَالَ سَعِيدُ بْنُ سَالِمٍ: إِنْ كَانَ صَدَاقَ مِثْلِهِنَّ جَازَ، وَإِنْ كَانَ أَكْثَرَ رُدَّتِ الزِّيَادَةُ وَقَالَ فِي الْمُحَابَاةِ كَمَا قُلْتُ أَنَا فِي كِتَابِ الْوَصَايَا الَّذِي لَمْ يَسْمَعْ مِنْهُ.
It is narrated from Ikrimah bin Khalid that the son of Umm Hakim, during his illness, said to his wife that she should give something to him from his inheritance, but the woman refused. So the son of Umm Hakim said, "I will include in this inheritance those who will diminish your right or prove harmful in it." Therefore, during his illness, he married three women, and gave each of them a dowry of one thousand. Abdul Malik bin Marwan declared this permissible. Saeed bin Salim says, "If the dowry of these women is equal to the customary dowry, then it is valid, and if it is more than the customary amount, then the excess should be returned."

Hadith 1121
أَخْبَرَنَا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ: أَنَّهُ سَمِعَ عِكْرِمَةَ بْنَ خَالِدٍ يَقُولُ: أَرَادَ عَبْدُ الرَّحْمَنِ ابْنُ أُمِّ الْحَكَمِ فِي شَكْوَاهُ أَنْ يُخْرِجَ امْرَأَةً مِنْ مِيرَاثِهَا فَأَبَتْ فَنَكَحَ عَلَيْهَا ثَلَاثَ نِسْوَةٍ وَأَصْدَقَهُنَّ أَلْفَ دِينَارٍ كُلَّ امْرَأَةٍ مِنْهُنَّ، فَأَجَازَ ذَلِكَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ وَشَرَّكَ بَيْنَهُنَّ فِي الثُّمُنِ. قَالَ الرَّبِيعُ: هَذَا قَوْلُ الشَّافِعِيِّ نَصٌّ، قَالَ الشَّافِعِيُّ: أَرَى ذَلِكَ صَدَاقَ مِثْلِهِنَّ وَلَوْ كَانَ أَكْثَرَ مِنْ صَدَاقِ مِثْلِهِنَّ جَازَ النِّكَاحُ، وَبَطَلَ مَا زَادَ عَلَى صَدَاقِ مِثْلِهِنَّ إِنْ مَاتَ مِنْ مَرَضِهِ ذَلِكَ؛ لِأَنَّهُ فِي حُكْمِ الْوَصِيَّةِ وَالْوَصِيَّةُ لَا تَجُوزُ لِوَارِثٍ.
Ikrimah bin Khalid narrates that Abdur Rahman bin Umm Hakam, during his illness, intended that his wife should take out a share from his inheritance (for charity, etc.), but the woman refused. So he married three other women and gave each of them a dowry of one thousand dinars. Abdul Malik bin Marwan declared it permissible and made all of them partners in the eighth share. Imam Shafi’i (may Allah have mercy on him) said: “In my opinion, this was the mahr al-mithl (customary dowry), and if it is more than the mahr al-mithl, then the marriage is still valid, but the amount exceeding the mahr al-mithl will be invalid if he dies in that same illness. Because this is in the ruling of a bequest, and a bequest is not permissible for an heir.”

Hadith 1122
أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ مُوسَى بْنِ عُقْبَةَ، عَنْ نَافِعٍ مَوْلَى ابْنِ عُمَرَ: أَنَّهُ قَالَ: كَانَتْ بِنْتُ حَفْصِ بْنِ الْمُغِيرَةِ عِنْدَ عَبْدِ اللَّهِ بْنِ أَبِي رَبِيعَةَ وَطَلَّقَهَا تَطْلِيقَةً، ثُمَّ إِنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ تَزَوَّجَهَا فَحُدِّثَ أَنَّهَا عَاقِرٌ لَا تَلِدُ، فَطَلَّقَهَا قَبْلَ مُجَامَعَتِهَا فَمَكَثَتْ حَيَاةَ عُمَرَ وَبَعْضَ خِلَافَةِ عُثْمَانَ، ثُمَّ تَزَوَّجَهَا عَبْدُ اللَّهِ بْنُ أَبِي رَبِيعَةَ وَهُوَ مَرِيضٌ لِتَشْرَكَ نِسَاءَهُ فِي الْمِيرَاثِ وَكَانَ بَيْنَهَا وَبَيْنَهُ قَرَابَةٌ.
Nafi’, the freed slave of Ibn ‘Umar (may Allah be pleased with them), narrated that the daughter of Hafs bin Mughira was married to ‘Abdullah bin Abi Rabiah, and he divorced her. Then ‘Umar bin Khattab (may Allah be pleased with him) married her. It was reported to him that this woman was barren and did not bear children, so he divorced her before consummating the marriage. She remained in this state during the life of ‘Umar (may Allah be pleased with him) and for some time during the caliphate of ‘Uthman (may Allah be pleased with him). Then ‘Abdullah bin Abi Rabiah married her again while he was ill, so that she could inherit from him among his wives, and there was also kinship between them.

Hadith 1123
أَخْبَرَنَا الرَّبِيعُ فِي كِتَابِ النِّكَاحِ فِي الْإِمْلَاءِ قَالَ: حَدَّثَنَا الشَّافِعِيُّ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ نَافِعٍ: أَنَّ ابْنَ أَبِي رَبِيعَةَ نَكَحَ وَهُوَ مَرِيضٌ فَجَازَ ذَلِكَ. أَخْرَجَ الْأَرْبَعَةَ الْأَحَادِيثَ مِنْ كِتَابِ النِّكَاحِ.
It is narrated from Nafi' (may Allah have mercy on him) that Ibn Abi Rabiah contracted marriage during illness and it was considered permissible.
