Hadith 1084
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ: أَنَّ طَارِقَ بْنَ الْمُرَقَّعِ أَعْتَقَ أَهْلَ بَيْتٍ سَوَائِبَ وَأَتَى بِمِيرَاثِهِمْ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: أَعْطُوهُ وَرَثَةَ طَارِقٍ فَأَبَوْا أَنْ يَأْخُذُوهُ، فَقَالَ عُمَرُ: فَاجْعَلُوهُ فِي مِثْلِهِمْ مِنَ النَّاسِ.
It is narrated from Ata bin Abi Rabah that Tariq bin Murraq set his household slaves free as Saibah, then his inheritance came. So Umar bin Khattab, may Allah be pleased with him, said: "Give this to the heirs of Tariq," but they refused to take it, so Umar, may Allah be pleased with him, said: "Distribute it among people like them."
Hadith 1085
أَخْبَرَنَا مُسْلِمٌ وَسَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ: أَنَّ طَارِقَ بْنَ الْمُرَقَّعِ أَعْتَقَ أَهْلَ أَبْيَاتٍ مِنْ أَهْلِ الْيَمَنِ سَوَائِبَ، فَانْقَلَعُوا عَنْ بِضْعَةَ عَشَرَ أَلْفًا، فَذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَأَمَرَنِي أَنْ أَدْفَعَ إِلَى طَارِقٍ، أَوْ وَرَثَةِ طَارِقٍ أَنَا شَكَكْتُ فِي الْحَدِيثِ هَكَذَا. أَخْرَجَ الْأَوَّلَ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَهُوَ آخِرُ حَدِيثٍ فِيهِ، وَالثَّانِيَ مِنْ كِتَابِ صِفَةِ أَمْرِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَهُوَ آخِرُ حَدِيثٍ فِيهِ.
It is narrated from Ata that Tariq bin Marqa’ freed some slaves as Saibah among his family in Yemen. Then he left ten thousand and some inheritance. When this matter was mentioned to Umar bin Khattab (may Allah be pleased with him), he ordered me to return this to Tariq or to the heirs of Tariq. I have some doubt about this matter in the narration.
