Hadith 1083
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِيهِ: أَنَّهُ أَخْبَرَهُ أَنَّ الْعَاصَ بْنَ هِشَامٍ هَلَكَ وَتَرَكَ بَنِينَ لَهُ ثَلَاثَةً: ابْنَيْنِ لِأُمٍّ، وَرَجُلًا لِعِلَّةٍ فَهَلَكَ أَحَدُ اللَّذَيْنِ لِأُمٍّ، وَتَرَكَ مَالًا وَمَوَالِيَ، فَوَرِثَهُ أَخُوهُ الَّذِي لِأُمِّهِ وَلِأَبِيهِ مَالَهُ وَوَلَاءَ مَوَالِيهِ ثُمَّ هَلَكَ الَّذِي وَرِثَ الْمَالَ وَوَلَاءَ الْمَوَالِي وَتَرَكَ ابْنَهُ وَأَخَاهُ لِأَبِيهِ، فَقَالَ ابْنُهُ: قَدْ أَحْرَزْتُ مَا كَانَ أَبِي أَحْرَزَ مِنَ الْمَالِ وَوَلَاءَ الْمَوَالِي، وَقَالَ أَخُوهُ: لَيْسَ كَذَلِكَ إِنَّمَا أَحْرَزْتُ الْمَالَ فَأَمَّا وَلَاءُ الْمَوَالِي فَلَا، أَرَأَيْتَ لَوْ هَلَكَ أَخِي الْيَوْمَ أَلَسْتُ أَرِثُهُ أَنَا؟ فَاخْتَصَمَا إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ فَقَضَى لِأَخِيهِ بِوَلَاءِ الْمَوَالِي. أَخْرَجَهُ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.
Abu Bakr bin Abdur Rahman bin Harith bin Hisham narrated that As bin Hisham died and he left behind three sons: two full brothers and one half-brother (from a different mother). One of the full brothers died and left behind wealth and freed slaves as inheritance. His full brother became the heir of his wealth and the wala’ (right of allegiance) of his freed slaves. Then the one who inherited the wealth and the wala’ of the slaves also died, and among his heirs were a son and a half-brother. So his son said: “I am the heir of the wealth and the wala’ of the freed slaves which my father had acquired.” But the deceased’s brother said: “The matter is not like that, because you have inherited the wealth, but not the wala’ of the slaves. What do you think—if my brother had died today, would I not have been his heir?” So both of them brought their dispute to Uthman (may Allah be pleased with him), and he decided the wala’ of the freed slaves in favor of the brother.
