Hadith 1072
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا عَبْدُ الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنِي قَيْسُ بْنُ سَعْدٍ: أَنَّهُ سَمِعَ مَكْحُولًا، يَقُولُ: سَمِعْتُ ابْنَ الْمُسَيِّبِ، يَقُولُ: أَعْتَقَتِ امْرَأَةٌ أَوْ رَجُلٌ سِتَّةَ أَعْبُدٍ لَهَا، وَلَمْ يَكُنْ لَهَا مَالٌ غَيْرُهُ فَأُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ، فَأَقْرَعَ بَيْنَهُمْ فَأَعْتَقَ ثُلُثَهُمْ. قَالَ الشَّافِعِيُّ: كَانَ ذَلِكَ فِي مَرَضِ الْمُعْتِقِ الَّذِي مَاتَ فِيهِ.
Saeed bin Musayyib (may Allah have mercy on him) narrates that a woman or a man freed his six slaves, while he had no other wealth besides them. This matter was brought before the Prophet ﷺ, so he ﷺ drew lots among the slaves and freed one third of them (i.e., two). Imam Shafi’i (may Allah have mercy on him) said: This incident of freeing (the slaves) was during the illness in which the person died.
Hadith 1073
أَخْبَرَنَا عَبْدُ الْوَهَّابِ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلَابَةَ، عَنْ أَبِي الْمُهَلَّبِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ: أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَوْصَى عِنْدَ مَوْتِهِ فَأَعْتَقَ سِتَّةَ مَمَالِيكَ، وَلَيْسَ لَهُ مَالٌ غَيْرَهُمْ، أَوْ قَالَ: أَعْتَقَ عِنْدَ مَوْتِهِ سِتَّةَ مَمَالِيكَ وَلَيْسَ لَهُ شَيْءٌ غَيْرَهُمْ، فَبَلَغَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ فِيهِ قَوْلًا شَدِيدًا ثُمَّ دَعَاهُمْ فَجَزَّأَهُمْ ثَلَاثَةَ أَجْزَاءٍ، فَأَقْرَعَ بَيْنَهُمْ فَأَعَتْقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً. أَخْرَجَ الْحَدِيثَيْنِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ.
It is narrated from Imran bin Husain (may Allah be pleased with him) that a man from among the Ansar made a bequest at the time of his death and freed six slaves, and he had no wealth other than them. Or he said (the narrator is unsure whether the words were): At the time of his death, he freed six slaves and had nothing besides them. This matter reached the Prophet ﷺ, and he ﷺ expressed strong displeasure at this. Then he ﷺ called for those slaves, divided them into three groups, and by drawing lots, freed two of them, and kept four as slaves (in the ownership of the heirs).
