Hadith 727
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَأَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "وَفِي الرِّكَازِ الْخُمُسُ" .
It is narrated from Abu Huraira (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "And there is a fifth (share) in the buried treasure."
Hadith 728
أَخْبَرَنَا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، عَنِ الْأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "فِي الرِّكَازِ الْخُمُسُ" .
It is narrated from Abu Huraira (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "There is a fifth (share) in buried treasure (Rikaz)."
Hadith 729
أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ، وَأَبِي سَلَمَةَ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "فِي الرِّكَازِ الْخُمُسُ" .
It is narrated from Ibn Musayyib and Abu Salamah that the Prophet (peace be upon him) said: "There is a fifth (share) in the buried treasure (Dafeenah)."
Hadith 730
أَخْبَرَنَا سُفْيَانُ، عَنْ دَاوُدَ بْنِ شَابُورٍ، وَيَعْقُوبَ بْنِ عَطَاءٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فِي كَنْزٍ وَجَدَهُ رَجُلٌ فِي خَرِبَةٍ جَاهِلِيَّةٍ: "وَإِنْ وَجَدْتَهُ فِي قَرْيَةٍ مَسْكُونَةٍ أَوْ فِي سَبِيلِ مَيْتَاءَ فَعَرِّفْهُ، وَإِنْ وَجَدْتَهُ فِي خَرِبَةٍ جَاهِلِيَّةٍ أَوْ فِي قَرْيَةٍ غَيْرِ مَسْكُونَةٍ، فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ" .
Amr bin Shu'aib narrates from his father, who narrates from his grandfather, that the Prophet (peace be upon him) said regarding the treasure which a man found in a deserted land of the pre-Islamic period: "And if you found it in a populated town or on a public road, then announce it, and if you found it in a deserted place of the pre-Islamic period or an uninhabited settlement, then there is a fifth in it and in buried treasure."
Hadith 731
أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، قَالَ: حَدَّثَنِي إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ قَالَ: جَاءَ رَجُلٌ إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ فَقَالَ: إِنِّي وَجَدْتُ أَلْفًا وَخَمْسَ مِائَةِ دِرْهَمٍ فِي خَرِبَةٍ بِالسَّوَادِ، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: أَمَا لَأَقْضِيَنَّ فِيهَا قَضَاءً بَيِّنًا، إِنْ كُنْتَ وَجَدْتَهَا فِي قَرْيَةٍ يُؤَدِّي خَرَاجَهَا قَرْيَةٌ أُخْرَى فَهِيَ لِأَهْلِ تِلْكَ الْقَرْيَةِ، وَإِنْ كُنْتَ وَجَدْتَهَا فِي قَرْيَةٍ لَيْسَ يُؤَدِّي خَرَاجَهَا قَرْيَةٌ أُخْرَى فَلَكَ أَرْبَعَةُ أَخْمَاسٍ، وَلَنَا الْخُمُسُ، ثُمَّ الْخُمُسُ لَكَ.
It is narrated from Sha'bi (may Allah have mercy on him) who states that a man came to Ali (may Allah be pleased with him) and said: I have found fifteen hundred dirhams in an uninhabited place in the region of Sawad. Ali (may Allah be pleased with him) said: I will give a very clear ruling on this. If you found it in such an uninhabited place that is adjacent to another settlement, then this money belongs to the people of that settlement. And if you found it in such a settlement whose uninhabited area is not adjacent to another, then four-fifths are for you and one-fifth is for us, then another fifth is for you.
Hadith 732
أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدٍ، وَأَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "وَفِي الرِّكَازِ الْخُمُسُ" أَخْرَجَ الْخَمَسَةَ الْأَحَادِيثَ مِنْ كِتَابِ الزَّكَاةِ، وَالسَّادِسَ مِنْ كِتَابِ الرِّسَالَةِ.
It is narrated from Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "And in buried treasure (Dafeenah) there is a fifth (as zakat)."
