Hadith 651
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَجُلًا أَفْطَرَ فِي شَهْرِ رَمَضَانَ، فَأَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِعِتْقِ رَقَبَةٍ أَوْ صِيَامِ شَهْرَيْنِ مُتَتَابِعَيْنِ أَوْ إِطْعَامِ سِتِّينَ مِسْكِينًا، فَقَالَ: إِنِّي لَا أَجِدُ، فَأُتِيَ رَسُولُ اللَّهِ بِعَرَقِ تَمْرٍ، فَقَالَ: "خُذْ هَذَا فَتَصَدَّقْ بِهِ" . فَقَالَ: يَا رَسُولَ اللَّهِ مَا أَحَدٌ أَحْوَجَ مِنِّي، فَضَحِكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَتَّى بَدَتْ ثَنَايَاهُ ثُمَّ قَالَ: "كُلْهُ" . قَالَ الشَّافِعِيُّ: وَكَانَ فِطْرُهُ بِجِمَاعٍ.
It is narrated from Abu Huraira (may Allah be pleased with him) that a man broke his fast in Ramadan (by having intercourse), so the Prophet (peace be upon him) ordered him to free a slave, or to fast for two consecutive months, or to feed sixty needy people. The man said: "I do not have the ability to do that." A large basket of dates was brought to the Prophet (peace be upon him). He said: "Take it and give it as charity." The man said: "There is no one more needy than me." At this, the Messenger of Allah (peace be upon him) laughed so much that his front teeth became visible, then he said: "Alright, (go and) eat it yourself." Imam Shafi'i (may Allah have mercy on him) said: "His fast was broken because of intercourse."
Hadith 652
أَخْبَرَنَا مَالِكٌ، عَنْ عَطَاءٍ الْخُرَاسَانِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: أَتَى أَعْرَابِيٌّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَنْتِفُ شَعْرَهُ، وَيَضْرِبُ نَحْرَهُ، وَيَقُولُ: هَلَكَ الْأَبْعَدُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: وَمَا ذَاكَ؟ قَالَ: أَصَبْتُ أَهْلِي فِي رَمَضَانَ وَأَنَا صَائِمٌ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "هَلْ تَسْتَطِيعُ أَنْ تَعْتِقَ رَقَبَةً" ؟ قَالَ: لَا. قَالَ: "فَهَلْ تَسْتَطِيعُ أَنْ تُهْدِيَ بَدَنَةً" ؟ قَالَ: لَا. قَالَ: "فَاجْلِسْ" . قَالَ: فَأُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِعَرَقِ تَمْرٍ فَقَالَ: خُذْ هَذَا فَتَصَدَّقْ بِهِ، قَالَ: مَا أَجِدُ أَحَدًا أَحْوَجَ مِنِّي، قَالَ: "فَكُلْهُ، وَصُمْ يَوْمًا مَكَانَ مَا أَصَبْتَ" . قَالَ عَطَاءٌ: فَسَأَلْتُ سَعِيدًا: كَمْ فِي ذَلِكَ الْعَرَقِ؟ قَالَ: مَا بَيْنَ خَمْسَةَ عَشَرَ صَاعًا إِلَى عِشْرِينَ.
Saeed bin Musayyib (may Allah have mercy on him) narrates that a Bedouin came to the Messenger of Allah ﷺ, he was pulling out his hair and beating his chest, and saying: and he was beating his chest and saying: "Separation has destroyed me." The Messenger of Allah ﷺ asked: "What happened?" He said: "I had intercourse with my wife while fasting in Ramadan." The Messenger of Allah ﷺ asked: "Do you have the ability to free a slave?" He said: "No." He ﷺ asked: "Do you have the ability to sacrifice a camel?" He said: "No." He ﷺ said: "Alright, sit down." Saeed bin Musayyib (may Allah have mercy on him) says that a large bag of dates was presented to the Messenger of Allah ﷺ, and he ﷺ said: "Take this and give it in charity." The man said: "I do not find anyone more needy than myself." He ﷺ said: "Eat it, and fast another day in place of that (intercourse) day." Ata (may Allah have mercy on him) says: I asked Saeed bin Musayyib (may Allah have mercy on him): "How many dates were in that bag?" He replied: "Between 15 and 20 sa’."
Hadith 653
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ: أَنَّ ابْنَ عُمَرَ سُئِلَ عَنِ الْمَرْأَةِ الْحَامِلِ إِذَا خَافَتْ عَلَى وَلَدِهَا، قَالَ: تُفْطِرُ وَتُطْعِمُ مَكَانَ كُلِّ يَوْمٍ مِسْكِينًا مُدًّا مِنْ حِنْطَةٍ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الصِّيَامِ، وَالثَّالِثَ فِي كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ رَضِيَ اللَّهُ عَنْهُمَا.
It is narrated from Nafi' (may Allah have mercy on him) that Ibn Umar (may Allah be pleased with them both) was asked about a pregnant woman: what should she do if she fears for her child? He (may Allah be pleased with him) replied: She should not fast and for each day she should feed a poor person with one mudd of wheat.
