Hadith 878

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: قُلْتُ لِعَطَاءٍ: قَوْلُ اللَّهِ تَعَالَى: لا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا [الْمَائِدَةِ: 95] قَالَ: قُلْتُ لَهُ: فَمَنْ قَتَلَهُ خَطَأً أَيَغْرَمُ؟ قَالَ: نَعَمْ. يُعَظِّمُ بِذَلِكَ حُرُمَاتِ اللَّهِ وَمَضَتْ بِهِ السُّنَنُ.
It is narrated from Ibn Jurayj (may Allah have mercy on him) that he said: "I asked Ata (may Allah have mercy on him) about the statement of Allah: 'Do not kill game while you are in the state of Ihram, and whoever among you kills it intentionally...' (__QUR_N__ Al-Ma'idah: 95) — Is there also a penalty for the one who kills unintentionally?" Ata (may Allah have mercy on him) said: "Yes, this is out of reverence for the sanctities of Allah, and this is how it has been practiced."
