Hadith 1815

قَالَ الرَّبِيعُ: سَمِعْتُ الشَّافِعِيَّ رَضِيَ اللَّهُ عَنْهُ يَقُولُ: سُئِلَ أَبُو حَنِيفَةَ رَضِيَ اللَّهُ عَنْهُ عَنِ الصَّائِمِ يَأْكُلُ وَيَشْرَبُ وَيَطَأُ إِلَى اطِّلَاعِ الْفَجْرِ، وَكَانَ عِنْدَهُ رَجُلٌ نَبِيلٌ، فَقَالَ: أَرَأَيْتَ إِنْ طَلَعَ الْفَجْرُ نِصْفَ اللَّيْلِ؟ فَقَالَ: الْزَمِ الصَّمْتَ يَا أَعْرَجُ.
Rabi’ said: I heard Imam Shafi’i (may Allah have mercy on him) say: Imam Abu Hanifa (may Allah have mercy on him) was asked about a fasting person who eats, drinks, and has intercourse until the break of dawn (what is the ruling on this?). There was a respected man sitting with him who said: “What do you think if dawn breaks in the middle of the night?” So he (may Allah have mercy on him) said: “O lame one! Be silent.”
