Malik bin Aws bin Hadthan (may Allah have mercy on him) narrates that I heard Umar bin Khattab (may Allah be pleased with him) while Abbas and Ali (may Allah be pleased with them both) also came to him with a dispute regarding the property of the Prophet ﷺ (which Allah had given to him as Fay’). So Umar (may Allah be pleased with him) said: “The property of Banu Nadir was given by Allah to His Messenger without any battle, for which the Muslims did not race horses or camels. And this property was specifically for the Messenger of Allah ﷺ, apart from the Muslims (i.e., the Companions had no share in it). So the Messenger of Allah ﷺ would give his family their annual expenses from it, and whatever remained, he would spend in preparation for jihad in the way of Allah on horses and war equipment. Then the Messenger of Allah ﷺ passed away, then Abu Bakr as-Siddiq (may Allah be pleased with him) acted as guardian over it in the same way as the Messenger of Allah ﷺ had done. Then I also acted as guardian over it in the same way as the Messenger of Allah ﷺ and Abu Bakr (may Allah be pleased with him) had done. Then both of you (Ali and Abbas, may Allah be pleased with them both) said to me that I should appoint you as guardians, so I appointed both of you as guardians on the condition that you both would act in it as the Messenger of Allah ﷺ and Abu Bakr (may Allah be pleased with him) had done. Now you both have come to me with a dispute; do you want me to give each of you half and half? Do you both now want a decision from me other than the previous decision? No! By the One by whose command the heavens and the earth stand, I will not make any decision among you except this. If you are unable to manage it, then hand over that property to me, and I will take care of it.”
Imam Shafi’i (may Allah have mercy on him) said that Sufyan (may Allah have mercy on him) said to me: “I did not hear this hadith from Zuhri (may Allah have mercy on him), and perhaps Amr bin Dinar (may Allah have mercy on him) told me from Zuhri (may Allah have mercy on him).” (Imam Shafi’i, may Allah have mercy on him, said) I asked: “Just as you have narrated the incident (was it exactly like this)?” He replied: “Yes.”
