Hadith 1721

أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ: أَنَّهُ سَمِعَ أَبَا غَطَفَانَ الْمُرِّيَّ قَالَ: اخْتَصَمَ زَيْدُ بْنُ ثَابِتٍ وَابْنُ مُطِيعٍ إِلَى مَرْوَانَ بْنِ الْحَكَمِ فِي دَارٍ، فَقَضَى بِالْيَمِينِ عَلَى زَيْدِ بْنِ ثَابِتٍ عَلَى الْمِنْبَرِ، فَقَالَ زَيْدٌ: أَحْلِفُ لَهُ مَكَانِي. قَالَ مَرْوَانُ: لَا وَاللَّهِ إِلَّا عِنْدَ مَقَاطِعِ الْحُقُوقِ، فَجَعَلَ زَيْدٌ يَحْلِفُ أَنَّ حَقَّهُ لَحَقٌّ، وَيَأْبَى أَنْ يَحْلِفَ عَلَى الْمِنْبَرِ، فَجَعَلَ مَرْوَانُ يَعْجَبُ مِنْ ذَلِكَ. قَالَ مَالِكٌ: كَرِهَ زَيْدٌ صَبْرَ الْيَمِينِ.
Abu Ghatfan Al-Mari narrated that Zaid bin Thabit (may Allah be pleased with him) and Ibn Muti’ brought a dispute about a (shared) house before Marwan bin Hakam. Marwan ruled that Zaid bin Thabit (may Allah be pleased with him) should take an oath on the pulpit. Zaid (may Allah be pleased with him) said: “I will take the oath at my place.” Marwan said: “No, by Allah! Take the oath where people’s cases are decided (i.e., on the pulpit).” So Zaid (may Allah be pleased with him) would take the oath that he was truthful, but refused to take the oath on the pulpit, and Marwan was astonished at this. Imam Malik (may Allah have mercy on him) said that Zaid (may Allah be pleased with him) disliked being forced to take an oath.
