Hadith 1694

أَخْبَرَنَا ابْنُ أَبِي يَحْيَى، عَنْ إِسْحَاقَ بْنِ أَبِي فَرْوَةَ، عَنْ عُمَرَ بْنِ الْحَكَمِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَجُلَيْنِ تَدَاعَيَا دَابَّةً، فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَا الْبَيِنَّةَ أَنَّهَا دَابَّتُهُ نَتَجَهَا فَقَضَى بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلَّذِي هِيَ فِي يَدَيْهِ. أَخْرَجَ الْأَوَّلَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ، وَالثَّانِيَ مِنْ كِتَابِ الدَّعْوَى وَالْبَيِّنَاتِ، وَهُوَ أَوَّلُ حَدِيثٍ فِيهِ.
It is narrated from Jabir bin Abdullah (may Allah be pleased with them both) that two men claimed ownership of an animal, and each of them presented testimony that the animal belonged to him and that he had raised (and bred) it. So the Messenger of Allah (ﷺ) decided in favor of the one in whose possession the animal was.
