It is narrated from Sulayman bin Yasar (may Allah have mercy on him) that a man from Banu Sa‘d bin Layth raced a horse and crushed the finger of a man from the tribe of Juhaynah, causing blood to flow, and that man died. ‘Umar (may Allah be pleased with him) said to the tribe of the one who crushed the finger: “Will you swear fifty oaths that the man did not die because of the crushed finger?” But they refused to swear. Then he said to the others (the heirs of the deceased): “You swear oaths,” but they also refused, and thus both parties refrained from swearing oaths.
