Hadith 1650

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةِ عَبْدٍ أَوْ وَلِيدَةٍ، فَقَالَ الَّذِي قُضِيَ عَلَيْهِ: كَيْفَ أَغْرَمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ وَمِثْلُ ذَلِكَ يُطَلُّ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ" .
It is narrated from Ibn Musayyib (may Allah have mercy on him) that the Prophet ﷺ gave the verdict of giving a slave or a slave-girl as compensation for the child who is killed in the womb of his mother. The one against whom the verdict was given said: "How can I pay compensation for something that has neither drunk nor eaten, neither spoken nor made any sound at the time of birth? In such a case, would the compensation not be wasted?" Upon this, the Messenger of Allah ﷺ said: "This person seems to be a brother of the soothsayers."
