Hadith 1639

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَنَّهُ قَالَ: "مَنْ قُتِلَ فِي عِمِّيَّةٍ رَمْيًا يَكُونُ بَيْنَهُمْ بِحِجَارَةٍ أَوْ جَلْدٍ بِالسَّوْطِ أَوْ ضَرْبٍ بِالْعَصَا، هُوَ خَطَأٌ عَقْلُهُ عَقْلُ الْخَطَأِ. وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدُ يَدِهِ، فَمَنْ حَالَ دُونَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَغَضَبُهُ، لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ" .
It is narrated from Tawus (may Allah have mercy on him) that he narrated from the Prophet ﷺ that he ﷺ said: "Whoever is killed in a riot, whoever among the fighters is killed by a stone, or by a whip, or by a blow from a stick, then that is accidental killing; its blood money is the blood money for accidental killing. And whoever is killed intentionally, then (the killer) has purchased retribution with his own hands. And whoever intervenes in this, upon him is the curse of Allah and His wrath; neither voluntary worship nor obligatory worship will be accepted from him."
