Hadith 1601

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، عَنِ اللَّيْثِ، عَنِ ابْنِ شِهَابٍ، عَنْ عَطَاءِ بْنِ يَزِيدَ اللَّيْثِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَدِيِّ بْنِ الْخِيَارِ، عَنِ الْمِقْدَادِ، أَنَّهُ أَخْبَرَهُ أَنَّهُ قَالَ: يَا رَسُولَ اللَّهِ، أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ، فَقَالَ: أَسْلَمْتُ للَّهِ، أَفَأَقْتُلُهُ يَا رَسُولَ اللَّهِ بَعْدَ أَنْ قَالَهَا؟ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا تَقْتُلْهُ" ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، إِنَّهُ قَطَعَ يَدِي، ثُمَّ قَالَ ذَلِكَ بَعْدَ أَنْ قَطَعَهَا، أَفَأَقْتُلُهُ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا تَقْتُلْهُ؛ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ، وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ" .
Miqdad (may Allah be pleased with him) narrated that he asked: O Messenger of Allah! What do you think if I encounter a disbeliever, and he fights me, then he strikes my hand with a sword and cuts it off, then he flees from me and takes refuge by a tree and says: "I have believed in Allah," so O Messenger of Allah! Should I kill him even after his declaration? The Messenger of Allah (peace be upon him) said: "Do not kill him." I said: O Messenger of Allah! He has cut off my hand, and he said this after cutting off my hand, so should I kill him? The Messenger of Allah (peace be upon him) said: "Do not kill him. The position you had before killing him is now his, and (if you kill him) your position will be what his was before he declared the testimony."
