أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّ عُبَيْدَ اللَّهِ بْنَ عَمْرٍو الْحَضْرَمِيَّ جَاءَ بِغُلَامٍ لَهُ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ لَهُ: اقْطَعْ يَدَ هَذَا؛ فَإِنَّهُ سَرَقَ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: فِي مَاذَا سَرَقَ؟ قَالَ: سَرَقَ مِرْآةً لِامْرَأَتِي ثَمَنُهَا سِتُّونَ دِرْهَمًا. فَقَالَ لَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: أَرْسِلْهُ لَيْسَ عَلَيْهِ قَطْعٌ، خَادِمُكُمْ سَرَقَ مَتَاعَكُمْ. [ ص: 283 ] أَخْرَجَهُ فِي كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ.
It is narrated from Sa’ib bin Yazid (may Allah be pleased with him) that Ubaidullah bin Amr al-Hadrami brought his slave to Umar bin Khattab (may Allah be pleased with him) and said: "Cut off his hand, he has committed theft." Umar bin Khattab (may Allah be pleased with him) asked: "What did he steal?" He said: "He stole my wife's mirror, which is worth sixty dirhams." So Umar (may Allah be pleased with him) said to them: "Let him go, his hand will not be cut off; he was your servant and he stole your property."
