أَخْبَرَنَا سُفْيَانُ، قَالَ: حَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ أَبِي يَزِيدَ، عَنْ أَبِيهِ: أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً، وَلَهَا ابْنَةٌ مِنْ غَيْرِهِ، وَلَهُ ابْنٌ مِنْ غَيْرِهَا، فَفَجَرَ الْغُلَامُ بِالْجَارِيَةِ، وَظَهَرَ بِهَا حَبَلٌ، فَلَمَّا قَدِمَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ مَكَّةَ، فَرُفِعَ ذَلِكَ إِلَيْهِ فَسَأَلَهُمَا فَاعْتَرَفَا، فَجَلَدَهُمَا عُمَرُ الْحَدَّ، وَحَرَصَ أَنْ يَجْمَعَ بَيْنَهُمَا، فَأَبَى الْغُلَامُ. أَخْرَجَ الْخَمْسَةَ الْأَحَادِيثَ مِنْ كِتَابِ اخْتِلَافِ الْحَدِيثِ، وَالسَّادِسَ وَالسَّابِعَ مِنْ كِتَابِ الرِّسَالَةِ، وَالثَّامِنَ مِنْ كِتَابِ الْيَمِينِ مَعَ الشَّاهِدِ، وَالتَّاسِعَ مِنْ كِتَابِ الْجَنَائِزِ، وَالْعَاشِرَ وَالْحَادِيَ عَشَرَ مِنْ كِتَابِ الْقَطْعِ فِي السَّرِقَةِ، وَالثَّانِيَ عَشَرَ مِنْ كِتَابِ عِشْرَةِ النِّسَاءِ.
Ubaidullah bin Abi Yazid narrated from his father that a man married a woman who had a daughter from her previous husband, and that man had a son from another wife. The boy committed adultery with the girl and she became visibly pregnant. When Umar (may Allah be pleased with him) came to Makkah, this matter was presented before him. He questioned both of them and they confessed. Then Umar (may Allah be pleased with him) imposed the punishment of lashes on both of them, and encouraged them to marry each other, but the boy refused.
