Hadith 1505

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ أَبِيهِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، اسْتَعْمَلَ مَوْلًى لَهُ يُقَالُ لَهُ: هُنَيٌّ عَلَى الْحِمَى، فَقَالَ لَهُ: يَا هُنَيُّ، ضُمَّ جَنَاحَكَ، وَاتَّقِ دَعْوَةَ الْمَظْلُومِ، فَإِنَّ دَعْوَةَ الْمَظْلُومِ مُجَابَةٌ. وَأَدْخِلْ رَبَّ الصُّرَيْمَةِ وَالْغُنَيْمَةِ. وَإِيَّايَ وَنَعَمَ ابْنِ عَفَّانَ وَنَعَمَ ابْنِ عَوْفٍ، فَإِنَّهُمَا إِنْ تَهْلِكْ مَاشِيَتُهُمَا يَرْجِعَانِ إِلَى نَخْلٍ وَزَرْعٍ، وَإِنَّ رَبَّ الْغُنَيْمَةِ يَأْتِي بِعِيَالِهِ فَيَقُولُ: يَا أَمِيرَ الْمُؤْمِنِينَ، يَا أَمِيرَ الْمُؤْمِنِينَ، أَفَتَارِكُهُمْ أَنَا؟ لَا أَبَا لَكَ، فَالْمَاءُ وَالْكَلَأُ أَهْوَنُ مِنَ الدَّنَانِيرِ وَالدَّرَاهِمِ، [ ص: 231 ] وَايْمُ اللَّهِ لَعَلَّ ذَلِكَ أَنَّهُمْ لَيَرَوْنُ أَنِّي قَدْ ظَلَمْتُهُمْ إِنَّهَا لَبِلَادُهَا قَاتَلُوا عَلَيْهَا فِي الْجَاهِلِيَّةِ، وَأَسْلَمُوا عَلَيْهَا فِي الْإِسْلَامِ. وَلَوْلَا الْمَالُ الَّذِي أَحْمِلُ عَلَيْهِ فِي سَبِيلِ اللَّهِ تَعَالَى مَا حَمَيْتُ عَلَى الْمُسْلِمِينَ مِنْ بِلَادِهِمْ شَيْئًا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الْأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.
Zaid bin Aslam narrated from his father that Umar bin Khattab (may Allah be pleased with him) appointed his slave named Hani as the supervisor of the (public) pasture, and addressed him saying: “O Hani! Restrain your hands (i.e., do not oppress anyone), beware of the supplication of the oppressed, for the supplication of the oppressed is accepted. Allow those who have a small number of camels and a small number of goats to enter the pasture, and be cautious regarding the livestock of the wealthy companions like Ibn Affan (meaning Uthman, may Allah be pleased with him) and Ibn Awf (Abdur Rahman, may Allah be pleased with him) (i.e., do not give preference to them over the poor because of their wealth), for if their animals perish, they can sustain themselves from their date orchards and fields, but if the animals of the one who owns only a few goats perish, he will come to you crying for his children and say: O Commander of the Faithful! O Commander of the Faithful! So should I leave them, may your father not exist (i.e., it is your duty to care for them). Providing them with water and fodder is easier than (giving them) dirhams and dinars. By Allah! Perhaps these people think that I have wronged them, because these are their lands, they fought battles for them in the days of ignorance, and even after accepting Islam, they still possess them. And if it were not for the wealth (meaning horses) on which I mount people for jihad, I would not have made even a small portion of the Muslims’ lands into pasture.”
