Hadith 1481

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ أَبِيهِ: أَنَّ عَبْدَ اللَّهِ وَعُبَيْدَ اللَّهِ ابْنَيْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ خَرَجَا فِي جَيْشٍ إِلَى الْعِرَاقِ، فَلَمَّا قَفَلَا، مَرَّا بِعَامِلٍ لِعُمَرَ رَضِيَ اللَّهُ عَنْهُمَا فَرَحَّبَ بِهِمَا وَسَهَّلَ وَهُوَ أَمِيرُ الْبَصْرَةِ، وَقَالَ: وَلَوْ أَقْدِرُ لَكُمَا عَلَى أَمْرٍ أَنْفَعُكُمَا بِهِ، لَفَعَلْتُ، ثُمَّ قَالَ: بَلَى إِنَّ هَهُنَا مَالًا مِنْ مَالِ اللَّهِ تَعَالَى أُرِيدُ أَنْ أَبْعَثَ بِهِ إِلَى أَمِيرِ الْمُؤْمِنِينَ، فَأُسْلِفُكُمَاهُ فَتَبْتَاعَانِ بِهِ مَتَاعًا مِنْ مَتَاعِ الْعِرَاقِ، ثُمَّ تَبِيعَانِهِ بِالْمَدِينَةِ، فَتُؤَدِّيَانِ رَأْسَ الْمَالَ إِلَى أَمِيرِ الْمُؤْمِنِينَ، وَيَكُونُ لَكُمَا الرِّبْحُ، فَقَالَا: وَدِدْنَا تَفْعَلُ، فَكَتَبَ لَهُمَا إِلَى عُمَرَ رَضِيَ اللَّهُ عَنْهُ أَنْ يَأْخُذَ مِنْهُمَا الْمَالَ، فَلَمَّا قَدِمَا الْمَدِينَةَ [ ص: 217 ] بَاعَا، فَرَبِحَا، فَلَمَّا دَفَعَا إِلَى عُمَرَ قَالَ لَهُمَا: أَكُلَّ الْجَيْشِ قَدْ أَسْلَفَهُ كَمَا أَسْلَفَكُمَا؟ فَقَالَا: لَا. فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: ابْنَا أَمِيرِ الْمُؤْمِنِينَ فَأَسْلَفَكُمَا. أَدِّيَا الْمَالَ وَرِبْحَهُ فَأَمَّا عَبْدُ اللَّهِ، فَسَكَتَ، وَأَمَّا عُبَيْدُ اللَّهِ، فَقَالَ: مَا يَنْبَغِي لَكَ هَذَا يَا أَمِيرَ الْمُؤْمِنِينَ، لَوْ هَلَكَ الْمَالُ أَوْ نَقُصَ، لَضَمِنَّاهُ، فَقَالَ: أَدِّيَاهُ، فَسَكَتَ عَبْدُ اللَّهِ وَرَاجَعَهُ عُبَيْدُ اللَّهِ. فَقَالَ رَجُلٌ مِنْ جُلَسَاءِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ: يَا أَمِيرَ الْمُؤْمِنِينَ لَوْ جَعَلْتَهُ قِرَاضًا، فَأَخَذَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ رَأْسَ الْمَالِ وَنِصْفَ رِبْحِهِ، وَأَخَذَ عَبْدُ اللَّهِ وَعُبَيْدُ اللَّهِ نِصْفَ رِبْحِ ذَلِكَ الْمَالِ. أَخْرَجَهُ مِنْ كِتَابِ الرُّهُونِ وَالْإِجَارَاتِ.
Zaid bin Aslam narrates from his father that the two sons of Umar bin Khattab (may Allah be pleased with him), Abdullah and Ubaidullah (may Allah be pleased with them), set out with the army of the Mujahideen towards Iraq. When both of them turned back, they passed by one of Umar’s (may Allah be pleased with him) governors, who welcomed them, and he was the governor of Basra. He said: “If I had authority over any matter by which I could benefit you, I would certainly do so.” Then he said: “Yes! (I remember) Here is some wealth from the wealth of Allah which I want to send to the Commander of the Faithful. I will give it to you as a loan; you both buy goods from Iraq with it and sell them in Madinah. Then give the principal amount to the Commander of the Faithful, and the profit will be yours.” Both of them said: “We agree, give us the wealth.” Then the governor of Basra wrote a letter to Umar (may Allah be pleased with him) for them to receive the wealth. When both of them came to Madinah, they sold the goods and made a profit. Then when they gave the principal amount to Umar (may Allah be pleased with him), he asked both of them: “Did he give the same loan to all the people of the army as he gave to both of you?” They said: “No.” So Umar (may Allah be pleased with him) said: “A loan was given only to the two sons of the Commander of the Faithful! You must pay both the principal and the profit obtained from it.” Abdullah (may Allah be pleased with him) remained silent upon hearing this, but Ubaidullah (may Allah be pleased with him) said: “O Commander of the Faithful! This is not permissible for you, because if the wealth had been destroyed or there had been a loss, we would have been responsible for it (we would have had to bear it).” Umar (may Allah be pleased with him) again said: “Pay it.” Abdullah bin Umar (may Allah be pleased with him) remained silent, but Ubaidullah (may Allah be pleased with him) repeated his statement. Then one of the people sitting with Umar (may Allah be pleased with him) said: “O Commander of the Faithful! If you give it to them in the form of qirad (mudarabah), it would be better.” Then Umar (may Allah be pleased with him) took the principal and half of the profit, and Abdullah (may Allah be pleased with him) and Ubaidullah (may Allah be pleased with him) took half of the profit from that wealth.
