Hadith 1426

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ، عَنْ حُمَيْدِ بْنِ قَيْسٍ، عَنْ سُلَيْمَانَ بْنِ عَتِيقٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ السِّنِينَ، وَأَمَرَ بِوَضْعِ الْجَوَائِحِ. قَالَ الشَّافِعِيُّ: سَمِعْتُ سُفْيَانَ يُحَدِّثُ هَذَا الْحَدِيثَ كَثِيرًا فِي طُولِ مُجَالَسَتِي لَهُ مَا لَا أُحْصِي مَا سَمِعْتُهُ يُحَدِّثُهُ مِنْ كَثْرَتِهِ لَا يُذْكَرُ فِيهِ: "أَمَرَ بِوَضْعِ الْجَوَائِحِ" ، لَا يَزِيدُ عَلَى أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ السِّنِينَ ثُمَّ زَادَ بَعْدَ ذَلِكَ وَأَمَرَ بِوَضْعِ الْجَوَائِحِ، قَالَ سُفْيَانُ: وَكَانَ حُمَيْدٌ يَذْكُرُ بَعْدَ بَيْعِ السِّنِينَ كَلَامًا قَبْلَ وَضْعِ الْجَوَائِحِ لَا أَحْفَظُهُ وَكُنْتُ أَكُفُّ عَنْ ذِكْرِ وَضْعِ الْجَوَائِحِ؛ لِأَنِّي لَا أَدْرِي كَيْفَ كَانَ الْكَلَامُ، وَفِي الْحَدِيثِ أَمَرَ بِوَضْعِ الْجَوَائِحِ.
It is narrated from Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (ﷺ) forbade selling the fruit of trees for several years, and in the case of a calamity from the sky (which causes loss to the buyers of the fruit), he ordered that compensation be given for it. Imam Shafi’i (may Allah have mercy on him) said: “I heard Sufyan (may Allah have mercy on him) narrate this hadith many times; during the long period I stayed with him, he narrated this hadith so many times that I cannot count, and most of the time when I heard him narrate it, he did not mention ‘he ordered compensation for calamities’ (امر بوضع الجوائح), rather, he did not add anything to the Prophet’s (ﷺ) words ‘he forbade selling for years’ (نہی عن بیع السنین). Then later, he narrated ‘he ordered compensation for calamities.’” So Sufyan (may Allah have mercy on him) said: “Humaid used to mention something after the words ‘selling for years’ and before ‘compensation for calamities’ which I could not remember, and for this reason I refrained from mentioning the words ‘compensation for calamities,’ because I did not know what that thing was. And in this hadith, it is stated that in the case of a calamity from the sky, compensation should be given to the buyers for their loss.”
