Hadith 1414

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ. وَالْمُحَاقَلَةُ: أَنْ يَبِيعَ الرَّجُلُ الزَّرْعَ بِمِائَةِ فَرَقِ حِنْطَةٍ. وَالْمُزَابَنَةُ: أَنْ يَبِيعَ التَّمْرَ فِي رُءُوسِ النَّخْلِ بِمِائَةِ فَرَقٍ. وَالْمُخَابَرَةُ: كِرَاءُ الْأَرْضِ بِالثُّلُثِ وَالرُّبُعِ.
It is narrated from Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade mukhabarah, muhaqalah, and muzabanah. Muhaqalah is when a person sells wheat that is still in the ear for one hundred sa’ (a measure) of cleaned wheat. Muzabanah is when dates on the date-palm trees are sold for one hundred sa’ of dried dates. Mukhabarah is when land is given on sharecropping for a third or a fourth of the produce.
