Hadith 1406

أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ إِسْمَاعِيلَ الشَّيْبَانِيِّ أَوْ غَيْرِهِ، قَالَ: بِعْتُ مَا فِي رُءُوسِ نَخْلِي بِمِائَةِ وَسْقٍ، إِنْ زَادَ فَلَهُمْ، وَإِنْ نَقَصَ فَعَلَيْهِمْ، فَسَأَلْتُ ابْنَ عُمَرَ، فَقَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ هَذَا إِلَّا أَنَّهُ أَرْخَصَ فِي بَيْعِ الْعَرَايَا.
Ismail al-Shaybani or someone else narrated that I sold dates on the trees for one hundred wasq on the condition that if there were more, they would belong to the buyer, and if there were less (than one hundred wasq), the loss would also be on him. Then I asked Ibn Umar (may Allah be pleased with them) and he said that the Messenger of Allah (ﷺ) forbade doing so, except that he (ﷺ) permitted it in the sale of ‘ariyya.
