Hadith 1320

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ: أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا أَلْبَتَّةَ وَهُوَ غَائِبٌ بِالشَّامِ فَبَعَثَ إِلَيْهَا وَكِيلَهُ بِشَعِيرٍ فَسَخِطَتْهُ، فَقَالَ: وَاللَّهِ مَا لَكِ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ: "لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ" .
It is narrated from Fatimah bint Qais (may Allah be pleased with her) that Abu Amr bin Hafs gave her the third and final divorce while he was in Syria and not present there (i.e., he sent the divorce from there). His agent sent her some barley, at which she became upset. So he said: "By Allah! You have no right over us at all." (Hearing this) she went to the Messenger of Allah ﷺ and mentioned this matter to him, so he ﷺ said: "It is correct, your maintenance (expenses) are not his responsibility."
