Hadith 1314

أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، عَنْ هُشَيْمِ بْنِ بَشِيرٍ، عَنْ سَيَّارٍ أَبِي الْحَكَمِ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ فِي امْرَأَةِ الْمَفْقُودِ إِذَا قَدِمَ، وَتَزَوَّجَتِ امْرَأَتُهُ إِنْ شَاءَ طَلَّقَ، وَإِنْ شَاءَ أَمْسَكَ، وَلَا تُخَيَّرُ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْعِدَدِ.
It is narrated from Yasar bin Abi Al-Hakam that Ali (may Allah be pleased with him) said regarding a woman whose husband is missing: "When her husband returns and his wife has married someone else, then if he wishes, he may divorce her, and if he wishes, he may keep her in marriage, and the woman will not be given this choice."
