Hadith 1286

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ: كَانَ ابْنُ عُمَرَ [ ص: 116 ] يَقُولُ: إِذَا مَلَّكَ الرَّجُلُ امْرَأَتَهُ، فَالْقَضَاءُ مَا قَضَتْ إِلَّا أَنْ يُنَاكِرَهَا الرَّجُلُ، فَيَقُولَ: لَمْ أُرِدْ إِلَّا تَطْلِيقَةً وَاحِدَةً فَيَحْلِفُ عَلَى ذَلِكَ، وَيَكُونُ أَمْلَكَ لَهَا مَا كَانَتْ فِي عِدَّتِهَا.
It is narrated from Nafi‘ (may Allah have mercy on him) that Ibn ‘Umar (may Allah be pleased with him) used to say: When a man gives his wife the authority to divorce, then the decision is as the woman makes, except if the man denies it and says, “I intended only one divorce (i.e., I gave her the authority for one divorce),” and he swears an oath to that effect. And the husband has more authority over her as long as she is in her ‘iddah (waiting period).
