Hadith 1271

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ لَيْثِ بْنِ أَبِي سُلَيْمٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ، قَالَ: لَيْسَ لَهَا إِلَّا نِصْفُ الْمَهْرِ وَلَا عِدَّةٌ عَلَيْهَا. يَعْنِي لِمَنْ قَالَ اللَّهُ تَعَالَى: وَإِنْ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ وَقَدْ فَرَضْتُمْ لَهُنَّ فَرِيضَةً [الْبَقَرَةِ: 237] . وَقَوْلُ اللَّهِ تَعَالَى: ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا [الْأَحْزَابِ: 49] .
It is narrated from Ibn Abbas (may Allah be pleased with them) that he said: "For her, the dowry is half, and there is absolutely no waiting period (‘iddah) for her, meaning the woman about whom Allah Almighty has said: 'And if you divorce women before you have touched them and you have already specified a dowry for them...' (__QUR_2:237__) and Allah Almighty's statement: 'Then if you divorce them before you have touched them, there is no waiting period for you to count against them...' (__QUR_33:49__).”
