Hadith 1265

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ: أَنَّ مَوْلَاةً لِبَنِي عَدِيٍّ، يُقَالُ لَهَا: زَبْرَاءُ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ عَبْدٍ وَهِيَ يَوْمَئِذٍ أَمَةٌ فَعَتَقَتْ. قَالَتْ: فَأَرْسَلَتْ إِلَيَّ حَفْصَةُ فَدَعَتْنِي فَقَالَتْ: إِنِّي مُخْبِرَتُكِ خَبَرًا، وَلَا أُحِبُّ أَنْ تَصْنَعِي شَيْئًا إِنَّ أَمْرَكِ بِيَدِكِ مَا لَمْ يَمَسَّكِ زَوْجُكِ، قَالَتْ: فَفَارَقَتْهُ ثَلَاثًا. قَالَ الشَّافِعِيُّ: وَلَمْ تَقُلْ لَهَا حَفْصَةُ: لَا يَجُوزُ أَنْ تُطَلَّقِي ثَلَاثًا.
It is narrated from Urwah that the freed slave woman of Bani Adi, whose name was Zabra, informed him that when she was a slave, she was married to a slave man. Her master set her free. She says that Hafsa (may Allah be pleased with her) sent for me with a message and said: "I am going to tell you something, and I do not want you to do anything (hasty), and that is: now your matter is in your own hands until your husband has intercourse with you." She says that he separated from her three times. Imam Shafi’i (may Allah have mercy on him) said that Hafsa (may Allah be pleased with her) did not say to her that it is not permissible for you to give him three divorces.
