أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بُكَيْرٍ، عَنِ ابْنِ أَبِي عَيَّاشٍ: أَنَّهُ كَانَ جَالِسًا مَعَ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ وَعَاصِمِ بْنِ عُمَرَ قَالَ: فَجَاءَهُمَا مُحَمَّدُ بْنُ إِيَاسِ بْنِ الْبُكَيْرِ، فَقَالَ: إِنَّ رَجُلًا مِنْ أَهْلِ الْبَادِيَةِ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا فَمَاذَا تَرَيَانِ؟ فَقَالَ ابْنُ الزُّبَيْرِ: إِنَّ هَذَا الْأَمْرَ مَا لَنَا فِيهِ قَوْلٌ، اذْهَبْ إِلَى ابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ، فَإِنِّي تَرَكْتُهُمَا عِنْدَ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا فَسَلْهُمَا ثُمَّ ائْتِنَا فَأَخْبِرْنَا، فَذَهَبَ فَسَأَلَهُمَا. قَالَ ابْنُ عَبَّاسٍ لِأَبِي هُرَيْرَةَ: أَفْتِهِ يَا أَبَا هُرَيْرَةَ، فَقَدْ جَاءَتْكَ مُعْضِلَةٌ. فَقَالَ أَبُو هُرَيْرَةَ: الْوَاحِدَةُ تَبُتُّهَا، وَالثَّلَاثُ تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ. وَقَالَ ابْنُ عَبَّاسٍ مِثْلَ ذَلِكَ. قَالَ الشَّافِعِيُّ: وَلَمْ يَعِبَا عَلَيْهِ الثَّلَاثَ وَلَا عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ إِبَاحَةِ الطَّلَاقِ، وَإِلَى آخِرِ الْخَامِسِ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ.
It is narrated from Ibn Abi Ayash that he was sitting with Abdullah bin Zubair and Asim bin Umar (may Allah be pleased with them) when Muhammad bin Iyas bin Bukair came to them and asked: "A man from among the desert dwellers has given his wife three divorces before consummating the marriage. What do you say about this?" Upon this, Ibn Zubair (may Allah be pleased with him) said: "We do not have any knowledge about this matter. You should go to Ibn Abbas and Abu Hurairah (may Allah be pleased with them). I have found both of them present at Aisha's (may Allah be pleased with her) place. Ask them about the issue and then come back and inform us as well." He went and asked them, so Ibn Abbas (may Allah be pleased with him) said to Abu Hurairah (may Allah be pleased with him): "He has brought a serious matter to you, so give him a verdict!" Abu Hurairah (may Allah be pleased with him) said: "One divorce will make her irrevocably separated, and three will make her unlawful for him until she marries another husband." And Ibn Abbas (may Allah be pleased with him) also said the same. Imam Shafi'i (may Allah have mercy on him) said: "These three companions and Aisha (may Allah be pleased with her) did not dislike this."
