أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ، عَنْ مُحَمَّدِ بْنِ إِيَاسِ بْنِ بُكَيْرٍ قَالَ: طَلَّقَ رَجُلٌ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا ثُمَّ بَدَا لَهُ أَنْ يَنْكِحَهَا، فَجَاءَ يَسْتَفْتِي فَسَأَلَ أَبَا هُرَيْرَةَ، وَعَبْدَ اللَّهِ بْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا. فَقَالَا: لَا نَرَى أَنْ يَنْكِحَهَا حَتَّى تَزَوَّجَ زَوْجًا غَيْرَكَ. فَقَالَ: إِنَّمَا كَانَ طَلَاقِي إِيَّاهَا وَاحِدَةً، قَالَ ابْنُ عَبَّاسٍ: إِنَّكَ أَرْسَلْتَ مِنْ يَدِكَ مَا كَانَ لَكَ مِنْ فَضْلٍ.
Muhammad bin Iyas bin Bukair narrated that a man gave his wife three divorces before consummation, then he planned to marry her again, so he came to ask about the issue and inquired from Abu Hurairah and Ibn Abbas (may Allah be pleased with them). They said: In our opinion, he cannot marry her until she marries another husband. The man said, "I intended only one divorce." Ibn Abbas said: You have used up all your (entire) right.
