أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، وَابْنُ أَبِي نَجِيِحٍ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، قَالَ: كُنَّا عِنْدَ عَبْدِ اللَّهِ بْنِ عُمَرَ فَجَاءَهُ أَعْرَابِيٌّ، فَقَالَ: إِنِّي أَعْطَيْتُ بَعْضَ بَنِيَّ نَاقَةً حَيَاتَهُ. قَالَ عَمْرٌو فِي الْحَدِيثِ: وَإِنَّهَا تَنَاتَجَتْ، وَقَالَ ابْنُ أَبِي نَجِيحٍ فِي حَدِيثِهِ: وَإِنَّهَا أَضْنَتْ وَاضْطَرَبَتْ، فَقَالَ: هِيَ لَهُ حَيَاتَهُ وَمَوْتَهُ، قَالَ: فَإِنِّي تَصَدَّقْتُ بِهَا عَلَيْهِ، قَالَ: فَذَلِكَ أَبْعَدُ لَكَ مِنْهَا. أَخْرَجَ الْحَدِيثَيْنِ فِي كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ، وَالثَّالِثَ مِنْ كِتَابِ الصَّيْدِ وَالذَّبَائِحِ.
Habib bin Abi Thabit narrated that we were with Abdullah bin Umar (may Allah be pleased with them) when a Bedouin came and said: "I have given one of my sons a she-camel for as long as he lives." Amr said in the narration: "And it bore many offspring," and Ibn Abi Najih said in his narration: "Rather, it had many offspring and they became restless." Ibn Umar (may Allah be pleased with them) said: "The she-camel belongs to him, whether it lives or dies." The man said: "But I had given it to him as charity." He replied: "Then you cannot take it back under any circumstance."
