Hadith 395
395 - أَخْبَرَنَا أَبُو مُحَمَّدِ بْنُ النَّحَّاسِ، أنا أَبُو سَعِيدِ بْنُ الْأَعْرَابِيِّ، ثنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ الصَّبَّاحِ الزَّعْفَرَانِيُّ، ثنا بَكْرُ بْنُ بَكَّارٍ، ثنا سُفْيَانُ الثَّوْرِيُّ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ , عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ جُعِلَ قَاضِيًا فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ» هَذَا الْحَدِيثُ فِي فَوَائِدِ ابْنِ الْأَعْرَابِيِّ، وَفِيهِ: «فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ» وَهُوَ فِي حَدِيثِ الزَّعْفَرَانِيِّ بِحَذْفٍ فَقَدْ، وَرَأَيْتُهُ فِي مُعْجَمِ شُيُوخِ سُفْيَانَ الثَّوْرِيِّ عَنْ عُمَارَةَ بْنِ غَزِيَّةَ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ أَبِي هُرَيْرَةَ يَرْفَعُهُ فَذَكَرَ فِيهِ فَقَدْ
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates from the Prophet (peace and blessings be upon him) that he (peace and blessings be upon him) said: "Whoever is appointed as a judge, indeed he has been slaughtered without a knife." This hadith is also in Fawa'id Ibn al-A'rabi, and in it is: "So indeed he has been slaughtered without a knife." And in the hadith of Za'farani, the word "faqad" (indeed) is not present. And I have seen it in the Mu'jam of the shuyukh of Sufyan Thawri, with the chain of 'Ammarah bin Ghaziyyah from Sa'id al-Maqburi from Abu Hurairah, and they have narrated it as marfu' and in it the word "faqad" (indeed) is present.

396 - وَأَخْبَرَنَا أَبُو مُحَمَّدٍ التُّجِيبِيُّ، ثنا أَبُو سَعِيدِ بْنُ الْأَعْرَابِيِّ، ثنا عَبَّاسُ بْنُ الْفَضْلِ، ثنا نَصْرُ بْنُ عَلِيٍّ، ثنا فُضَيْلُ بْنُ سُلَيْمَانَ، عَنْ عَمْرِو بْنِ أَبِي عَمْرٍو، عَنْ سَعِيدٍ الْمَقْبُرِيِّ , عَنْ أَبِي هُرَيْرَةَ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ وَلِيَ الْقَضَاءَ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ»
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that indeed the Prophet, peace and blessings be upon him, said: "Whoever is appointed to the position of judge has truly been slaughtered without a knife."
