873 - أَخْبَرَنَا أَبُو مُسْلِمٍ، مُحَمَّدُ بْنُ أَحْمَدَ بْنِ عَلِيٍّ الْكَاتِبُ، ثنا أَبُو الْقَاسِمِ عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْبَغَوِيُّ، ثنا مُحَمَّدُ بْنُ جَعْفَرٍ الْوَرْكَانِيُّ، ثنا حَمَّادُ بْنُ يَحْيَى أَبُو بَكْرٍ الْأَبَحُّ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا طَاعَةَ لِمَخْلُوقٍ فِي مَعْصِيَةِ الْخَالِقِ» ، فِي الْأَصْلِ حَمَّادٌ عَنِ ابْنِ عَوْنٍ عَنْ مُحَمَّدِ بْنِ سِيرِينَ، وَفِي الْفَوَائِدِ حَمَّادٌ عَنِ ابْنِ سِيرِينَ
Sayyiduna Imran bin Husayn (may Allah be pleased with him) narrates from the Prophet (peace and blessings be upon him) that he said: "There is no obedience to the creation in disobedience to the Creator." (Its chain) in the original is Hammad from Ibn ‘Awn from Muhammad bin Sirin, while in "Al-Fawa’id" it is Hammad from Ibn Sirin.

The meaning is that if any created being—whether a leader or ruler, or a jurist (faqih) and mufti, or anyone else—gives such a command that, by acting upon it, disobedience to the Creator occurs, then such a command must never be obeyed; obedience is only in what is recognized as good (ma‘ruf). There is an incident from the blessed era of the Prophet sallallahu alayhi wa sallam: he sent out a military detachment (sariyyah) and appointed an Ansari man as its leader, instructing the people to obey him. Then, for some reason, the leader became angry with the people and said, “Did not the Messenger of Allah sallallahu alayhi wa sallam command you to obey me?” The people replied, “Of course.” He said, “Then I command you to gather firewood, light a fire, and then jump into it.” The people gathered firewood, lit the fire, and when they were about to jump in, they began to look at one another. Some among them said, “We obeyed the Messenger of Allah sallallahu alayhi wa sallam to save ourselves from the Fire—should we now enter it ourselves?” They were in doubt when the fire cooled down and the leader’s anger subsided. Then they (returned and) mentioned this incident to the Messenger of Allah sallallahu alayhi wa sallam, and he sallallahu alayhi wa sallam said, “If you had entered the fire, you would never have come out of it (or remember), obedience is only in what is good.” [بخاري : 7145 مسلم : 1840]

The statement of the Prophet sallallahu alayhi wa sallam is very clear: “Every Muslim should listen and obey in every matter, whether he likes it or dislikes it, provided he is not commanded to do something sinful; and if he is commanded to do something sinful, then there is no listening and obedience in that.” [بخاري : 7144 ، مسلم : 1839]
