Hadith 43

43 - وأنا ابْنُ السِّمْسَارِ، ثنا أَبُو زَيْدٍ، ثنا الْفَرَبْرِيُّ، ثنا الْبُخَارِيُّ، نا مُسَدَّدُ، نا عَبْدُ الْأَعْلَى بْنُ عَبْدِ الْأَعْلَى، نا مَعْمَرٌ، عَنْ هَمَّامٍ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ، يَقُولُ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَطْلُ الْغَنِيِّ ظُلْمٌ»
Sayyiduna Abu Huraira (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: "Delaying the repayment of a debt by a wealthy person is injustice."

Brief Explanation
Explanation—The meaning is that a debtor who, despite having the ability to repay the debt, procrastinates and delays without reason is a wrongdoer (zalim). The creditor is permitted to humiliate such a wrongdoer, and may even have him sent to jail. However, if the debtor is destitute and genuinely does not have the ability to repay the debt, then the ruling is not the same; rather, regarding such a debtor, the creditor is encouraged to grant him respite, for which there is great reward. In any case, unnecessary delay in the repayment of debt is not appropriate. The Prophet sallallahu alayhi wa sallam refused to perform the funeral prayer (janazah) for a debtor. (Bukhari: 2289) And on one occasion, he sallallahu alayhi wa sallam said that all the sins of a martyr (shaheed) are forgiven except for debt. He sallallahu alayhi wa sallam said that Jibril (Gabriel) has just informed me that “A martyr is not forgiven for debt.” (Muslim: 1885)
