Brief Explanation
Explanation: From this blessed hadith, it is understood that if a person unjustly tries to seize someone else's property—whether the property is little or much—and the owner has no option but to fight, then it is permissible to fight such a person. If the usurper is killed, his blood is wasted (i.e., there is no retribution for his death), and he is destined for Hell. And if, in this fight, the owner is killed, then Allah Ta'ala will grant him the reward of martyrdom (shahadah) as an honor, because protecting one's property is not only the owner's right but also a command of Allah and His Messenger. Therefore, the one who is killed in compliance with the command of Allah and His Messenger is a martyr (shaheed).
It is narrated in Sahih Muslim that a man came to the service of the Messenger of Allah (sallallahu alayhi wa sallam) and said: "O Messenger of Allah! Tell me, if someone comes and wants to take my property, what should I do?" The Prophet (sallallahu alayhi wa sallam) said: "Do not give him (your property)." He said: "If he starts to fight?" The Prophet (sallallahu alayhi wa sallam) said: "Then you also fight him." He said: "If he kills me?" The Prophet (sallallahu alayhi wa sallam) said: "You are a martyr." He said: "If I kill him?" The Prophet (sallallahu alayhi wa sallam) said: "He is in Hell." [مسلم رقم : 140]
Upon this hadith, Allamah Nawawi rahimahullah has established a chapter: "The blood of one who seizes another's property is lawful (i.e., there is no retribution for his death), and if he is killed during this fight, he is destined for Hell, and if the rightful owner is killed, he is a martyr." In another hadith, it is stated: "Whoever is killed while fighting for his right is a martyr." [نسائي : 4101 ، صحيح]
