329 - أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ عُمَرَ التُّجِيبِيُّ، ثنا أَحْمَدُ بْنُ مُحَمَّدٍ الْمَدَنِيُّ، ثنا يُونُسُ بْنُ عَبْدِ الْأَعْلَى، ثنا ابْنُ وَهْبٍ، ثنا ابْنُ لَهِيعَةَ وَعَمْرُو بْنُ الْحَارِثِ وَاللَّيْثُ بْنُ سَعْدٍ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ سِنَانِ بْنِ سَعِيدٍ الْكِنْدِيِّ، عَنْ أَنَسِ بْنِ مَالِكٍ، عَنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: «الْمُسْتَبَّانِ مَا قَالَا، فَعَلَى الْبَادِئِ حَتَّى يَعْتَدِيَ الْمَظْلُومُ» وَرَوَاهُ مُسْلِمُ بْنُ الْحَجَّاجِ، عَنْ يَحْيَى بْنِ أَيُّوبَ وَقُتَيْبَةَ، وَابْنِ حَجَرٍ قَالُوا: ثنا إِسْمَاعِيلُ، يَعْنُونَ: ابْنَ جَعْفَرٍ، عَنِ الْعَلَاءِ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: «الْمُسْتَبَّانِ مَا قَالَا، فَعَلَى الْبَادِئُ مَا لَمْ يَعْتَدِ الْمَظْلُومُ»
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates from the Messenger of Allah (peace and blessings be upon him) that indeed he (peace and blessings be upon him) said: "Whatever two people who abuse each other say, (the burden of it) will be upon the one who started it, as long as the oppressed does not exceed the limits." And Muslim bin Hajjaj has also narrated it with his chain from Sayyiduna Abu Hurairah (may Allah be pleased with him), who narrates from the Prophet (peace and blessings be upon him) that he (peace and blessings be upon him) said: "Whatever two people who abuse each other say, (the burden of it) will be upon the one who started it, as long as the oppressed does not exceed the limits."

From this blessed hadith, it is understood that if a person initiates abuse towards someone, then it is permissible for the other to respond with abuse only to the extent that he received. And the entire burden (sin) of this abusive exchange will be upon the one who started it, because it was this first person who became the cause for the other to utter abuse; therefore, its burden is upon him. However, if the oppressed exceeds the limit, that is, in response to one abuse he gives two, then both will be equally involved in the sin. Because the recompense for evil is an evil equal to it. And if the oppressed remains silent, does not retaliate, and exercises patience, then this is far superior. Allah Ta'ala says:
﴿فَمَنِ اعْتَدَىٰ عَلَيْكُمْ فَاعْتَدُوا عَلَيْهِ بِمِثْلِ مَا اعْتَدَىٰ عَلَيْكُمْ وَاتَّقُوا اللَّهَ وَاعْلَمُوا أَنَّ اللَّهَ مَعَ الْمُتَّقِينَ﴾ (Al-Baqarah: 194)
“So whoever transgresses against you, transgress against him in the same manner as he transgressed against you. And fear Allah and know that indeed Allah is with those who are mindful (of Him).”
In another place He said:
﴿وَجَزَاءُ سَيِّئَةٍ سَيِّئَةٌ مِّثْلُهَا فَمَنْ عَفَا وَأَصْلَحَ فَأَجْرُهُ عَلَى اللَّهِ إِنَّهُ لَا يُحِبُّ الظَّالِمِينَ ﴿٤٠﴾ وَلَمَنِ انتَصَرَ بَعْدَ ظُلْمِهِ فَأُولَٰئِكَ مَا عَلَيْهِم مِّن سَبِيلٍ ﴿٤١﴾ إِنَّمَا السَّبِيلُ عَلَى الَّذِينَ يَظْلِمُونَ النَّاسَ وَيَبْغُونَ فِي الْأَرْضِ بِغَيْرِ الْحَقِّ أُولَٰئِكَ لَهُمْ عَذَابٌ أَلِيمٌ ﴿٤٢﴾ وَلَمَن صَبَرَ وَغَفَرَ إِنَّ ذَٰلِكَ لَمِنْ عَزْمِ الْأُمُورِ ﴾ (Ash-Shura: 40-43)
“And the recompense of an evil is an evil like it, but whoever pardons and makes reconciliation, his reward is with Allah. Indeed, He does not love the wrongdoers. And whoever defends himself after being wronged, there is no blame upon them. The blame is only upon those who wrong people and transgress upon the earth without right; for them there is a painful punishment. And whoever is patient and forgives, indeed that is of the matters requiring determination.”
Similarly, in another place He said:
﴿وَإِنْ عَاقَبْتُمْ فَعَاقِبُوا بِمِثْلِ مَا عُوقِبْتُم بِهِ وَلَئِن صَبَرْتُمْ لَهُوَ خَيْرٌ لِّلصَّابِرِينَ﴾ (An-Nahl: 126)
“And if you retaliate, then retaliate with the like of that with which you were afflicted. But if you are patient, it is certainly better for those who are patient.”
Sayyiduna Abu Hurairah radi Allahu anhu narrates that a man abused Sayyiduna Abu Bakr as-Siddiq radi Allahu anhu while the Prophet sallallahu alayhi wa sallam was present. He was amazed and smiling. When that man became excessive in his rudeness, Sayyiduna Abu Bakr radi Allahu anhu responded to some of his words. At this, the Prophet sallallahu alayhi wa sallam became angry and stood up. Sayyiduna Abu Bakr radi Allahu anhu went to him and said: “O Messenger of Allah! He kept abusing me while you were present, but when I responded to some of his words, you became angry and stood up?” The Prophet sallallahu alayhi wa sallam said: “There was an angel with you who was responding to him, but when you responded, the Shaytan became present.” Then he said: “O Abu Bakr! Three things are absolutely true: Whoever is wronged and overlooks it for the sake of Allah, Allah the Exalted grants him strength and help in return. Whoever gives in order to maintain family ties, Allah gives him more in return. And whoever asks (begs) in order to increase his wealth, Allah only increases him in poverty.” [أحمد : 2/ 436 ، حسن]
