Hadith 1329
1329 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ، قَالَ: ثنا ابْنُ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ: «نَهَي رَسُولُ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمُزَابَنَةِ، وَالْمُحَاقَلَةِ، وَالْمُخَابَرَةِ، وَأَنْ لَا يُبَاعَ التَّمْرُ حَتَّي يَبْدُوَ صَلَاحُهُ، وَأَنْ لَا يُبَاعَ إِلَّا بِالدِّينَارِ، أَوِ الدِّرْهَمِ، إِلَّا أَنَّهُ رَخَّصَ فِي الْعَرَايَا» وَالْمُخَابَرَةِ: كَرْيُ الْأَرْضِ عَلَي الثُّلُثِ وَالرُّبْعِ، وَالْمُحَاقَلَةُ: بَيْعُ السُّنْبُلِ بِالْحِنْطَةِ، وَالْمُزَابَنَةُ: بَيْعُ الثَّمَرِ بِالتَّمْرِ "
Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) forbade muzabanah, muhaqalah, and mukhabarah, and also forbade selling dates before they ripen and become ready, and that they be sold only in exchange for dinars or dirhams. However, he (peace be upon him) permitted ‘ariyah transactions. Mukhabarah means that land is rented out for a third or a quarter of its produce. Muhaqalah means that the ears of wheat present in a field are sold. Muzabanah means that dates on the tree are sold in exchange for harvested dates.
