411 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ قَالَ: ثنا يَحْيَي بْنُ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَي بْنِ حَبَّانَ، عَنْ عَمِّهِ وَاسِعِ بْنِ حَبَّانَ أَنَّ عَبْدًا سَرَقَ وَدِيًّا مِنْ حَائِطِ رَجُلٍ فَجَاءَ بِهِ فَغَرَسَهُ فِي حَايِطِ أَهْلِهِ فَأَتَي بِهِ مَرْوَانَ بْنَ الْحَكَمِ فَأَرَادَ أَنْ يَقْطَعَهُ فَشَهِدَ رَافِعُ بْنُ خَدِيجٍ أَنَّ رَسُولَ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثْرٍ» فَأَرْسَلَهُ مَرْوَانُ.
Wasi‘ bin Hibban narrates: A slave stole a date palm sapling from a man’s garden and planted it in his master’s garden. He was caught and brought to Marwan bin Hakam. Marwan intended to have his hand cut off, but Sayyiduna Rafi‘ bin Khadij (may Allah be pleased with him) testified that the Noble Prophet (peace and blessings be upon him) had said: “The hand is not to be cut off for stealing fruit or palm shoots.” So Marwan let the man go.
