Hadith 367
367 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ قَالَ: ثنا مُجَالِدُ بْنُ سَعِيدٍ الْهَمْدَانِيُّ، عَنِ الشَّعْبِيِّ قَالَ: قَدِمَتْ فَاطِمَةُ بِنْتُ قَيْسٍ الْكُوفَةَ عَلَي أَخِيهَا الضَّحَاكِ بْنِ قَيْسٍ وَكَانَ عَامِلًا عَلَيْهَا، فَأَتَيْنَاهَا فَسَأَلْنَاهَا، فَقَالَتْ: كُنْتُ عِنْدَ أَبِي عَمْرِو بْنِ حَفْصِ بْنِ الْمُغِيرَةِ فَطَلَّقَنِي فَبَتَّ طَلَاقِي، وَخَرَجَ إِلَي الْيَمَنِ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ ذَلِكَ لَهُ وَطَلَبْتُ النَّفَقَةَ فَقَالَ بِكُمِّهِ هَكَذَا وَاسْتَتَرَ النَّبِيُّ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمَرْأَةِ، وَرَفَعَ أَبُو بَكْرٍ كُمَّهُ فَوْقَ رَأْسِهِ، «اسْمَعِي مِنِّي يَا بِنْتَ آلِ قَيْسٍ، إِنَّمَا السُّكْنَي وَالنَّفَقَةُ لِلْمَرْأَةِ إِذَا كَانَ لِزَوْجِهَا عَلَيْهَا رَجْعَةٌ، فَإِذَا لَمْ يَكُنْ لَهُ عَلَيْهَا رَجْعَةٌ فَلَا سُكْنَي لَهَا وَلَا نَفَقَةَ» ثُمَّ قَالَ لِي: «اعْتَدِّي عِنْدَ أُمِّ شَرِيكٍ بِنْتِ أَبِي الْعَكَرِ» ثُمَّ قَالَ: «تِلْكَ امْرَأَةٌ يُتَحَدَّثُ عِنْدَهَا، اعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ مَحْجُوبُ الْبَصَرِ فَتَضَعِينَ ثِيَابَكِ فَلَا يَرَاكِ»
Imam Sha’bi (may Allah have mercy on him) narrates: Sayyida Fatima bint Qais (may Allah be pleased with her) came to Kufa. She had come to her brother, Dahhak bin Qais, who was the governor there. We presented ourselves before her. We asked this lady, and she informed us: I was the wife of Amr bin Hafs. He divorced me with a final irrevocable divorce and himself went to Yemen. I presented myself before the Prophet Muhammad (peace and blessings be upon him). I mentioned this matter to the Prophet (peace and blessings be upon him) and demanded maintenance. The Prophet (peace and blessings be upon him) folded his sleeve in this manner (the Prophet, peace and blessings be upon him, observed hijab from this lady).
Imam Humaydi (may Allah have mercy on him) raised his sleeve over his head (demonstrating this) and said: “O daughter of the family of Qais! The right to residence and maintenance is for that woman whose husband has the right to take her back. But when the husband does not have the right to take her back, then the woman does not have the right to residence and maintenance.” Then the Prophet (peace and blessings be upon him) said to me: “Spend your waiting period at the house of Umm Sharik bint Abu’l-Akr (may Allah be pleased with her).” Then the Prophet (peace and blessings be upon him) said: “She is a woman in whose house people come and go, so spend your waiting period at the house of Ibn Umm Maktum, for he is a blind man. If you remove your cloak, even then he will not be able to see you.”
