Hadith 243
243 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ قَالَ: ثنا يَحْيَي بْنُ سَعِيدٍ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ، عَنْ عَائِشَةَ قَالَتْ: أَرَدْتُ أَنْ أَشْتَرِيَ بَرِيرَةَ فَأُعْتِقَهَا فَاشْتَرَطَ عَلَيَّ مَوَالِيهَا أَنْ أَعْتِقَهَا وَيَكُونُ الْوَلَاءُ لَهُمْ، فَسَأَلْتُ رَسُولَ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ: «اشْتَرِيهَا وَأَعْتِقِيهَا، فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» ، ثُمَّ خَطَبَ النَّاسَ فَقَالَ: «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ؟ فَمَنْ شَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ فَلَيْسَ لَهُ، وَإِنْ شَرَطَ مِائَةَ مَرَّةٍ، إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»
Mother of the believers, Lady Aisha (may Allah be pleased with her) narrates: I intended to buy Barirah so that I could set her free, but her owners stipulated that I would set her free but the wala’ (right of inheritance/loyalty) would remain with them. I asked the Prophet Muhammad (peace and blessings be upon him) about this, and he said: “Buy her and set her free, for the right of wala’ belongs to the one who sets free.” Then the Prophet Muhammad (peace and blessings be upon him) addressed the people in a sermon and said: “What is wrong with people that they stipulate conditions which are not in the Book of Allah? So whoever stipulates a condition that is not in the Book of Allah, he has no right to it, even if he stipulates it a hundred times. The right of wala’ belongs to the one who sets free.”
