Hadith 240

240 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ قَالَ: ثنا الزُّهْرِيُّ قَالَ: أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّهُ سَمِعَ عَائِشَةَ تَقُولُ: اخْتَصَمَ عِنْدَ رَسُولِ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَعَبْدُ اللَّهِ بْنُ زَمْعَةَ فِي ابْنِ أَمَةِ زَمْعَةَ فَقَالَ سَعْدٌ: يَا رَسُولَ اللَّهِ إِنَّ أَخِي عُتْبَةَ أَوْصَانِي فَقَالَ: إِذَا قَدِمْتَ مَكَّةَ فَانْظُرِ ابْنَ أَمَةِ زَمْعَةَ فَاقْبِضْهُ فَإِنَّهُ ابْنِي، وَقَالَ عَبْدُ اللَّهِ بْنُ زَمْعَةَ: يَا رَسُولَ اللَّهِ أَخِي وَابْنُ أَمَةِ أَبِي، وَوُلِدَ عَلَي فِرَاشِ أَبِي فَرَأَي رَسُولُ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ شَبَهًا بَيِّنًا بِعُتْبَةَ وَقَالَ: «هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ» فَقِيلَ لِسُفْيَانَ فَإِنَّ مَالِكًا يَقُولُ: وَلِلْعَاهِرِ الْحَجَرُ، فَقَالَ سُفْيَانُ لَكِنَّا لَمْ نَحْفَظْ عَنِ الزُّهْرِيِّ أَنَّهُ قَالَ فِي هَذَا الْحَدِيثِ
Mother of the Believers, Lady Aisha (may Allah be pleased with her) narrates: Sa’d bin Abi Waqqas (may Allah be pleased with him) and ‘Abd bin Zam’ah presented a case before the Prophet Muhammad (peace and blessings be upon him) regarding the son of Zam’ah’s slave woman. Sa’d (may Allah be pleased with him) said: O Messenger of Allah! My brother ‘Utbah made a bequest to me. He said that when you go to Makkah, look at the son of Zam’ah’s slave woman and take him into your custody, for he is my son. So ‘Abd bin Zam’ah said: O Messenger of Allah! He is my brother, the son of my father’s slave woman, who was born on my father’s bed. (The narrator says) The Prophet (peace and blessings be upon him) noticed a clear resemblance of the child with ‘Utbah, but he (peace and blessings be upon him) said: “O ‘Abd bin Zam’ah! He will go to you, for the child belongs to the bed (i.e., the owner of the bed). O Sawdah! Observe veil from him.” Sufyan was told: Imam Malik also narrates these words in this narration: “The fornicator gets deprivation.” So Sufyan said: We have not memorized these words from Zuhri, that he narrated these words in this narration.
أَخْبَرَنَا الشَّيْخُ الْإِمَامُ الْعَالِمُ الزَّاهِدُ الْحَافِظُ تَقِيُّ الدِّينِ أَبُو مُحَمَّدٍ عَبْدُ الْغَنَيِّ بْنُ عَبْدِ الْوَاحِدِ بْنِ عَلِيِّ بْنِ سُرُورٍ الْمَقْدِسِيُّ أَحْسَنَ اللَّهُ تَوْفِيقَهُ، قَالَ: أَخْبَرَنَا الْفَقِيهُ أَبُو الْحَسَنِ سَعْدُ اللَّهِ بْنُ نَصْرِ بْنِ الدَّجَّاجِيِّ، وَأَبُو الْمَعَالِي أَحْمَدُ بْنُ عَبْدِ الْغَنِيِّ بْنِ حَنِيفَةَ الْبَاجِسْرَائِيُّ، قَالَا: أَخْبَرَنَا اْلْإِمَامُ أَبُو مَنْصُورٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ عَلِيٍّ الْمُقْرِي الْمَعْرُوفُ بِالْخَيَّاطِ رَحِمَهُ اللَّهُ، قَالَ: أَخْبَرَنَا أَبُو طَاهِرٍ عَبْدُ الْغَفَّارِ بْنُ مُحَمَّدِ بْنِ جَعْفَرِ بْنِ زَيْدٍ الْمُؤَدِّبُ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ فِي عَشْرِ ذِي الْحِجَّةِ مِنْ سَنَةِ سَبْعٍ وَعِشْرِينَ وَأَرْبَعِمِائَةٍ، فَأَقَرَّ بِهِ، قَالَ: أَخْبَرَنَا أَبُو عَلِيٍّ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ بْنِ الصَّوَّافِ قِرَاءَةُ عَلَيْهِ وَأَنَا أَسْمَعُ، فَأَقَرَّ بِهِ، قَالَ: ثنا أَبُو عَلِيٍّ بِشْرُ بْنُ مُوسَي قَالَ:
The Sheikh, the Imam, the scholar, the ascetic, the memorizer, Taqi al-Din Abu Muhammad ‘Abd al-Ghani ibn ‘Abd al-Wahid ibn ‘Ali ibn Surur al-Maqdisi—may Allah grant him success—narrated to us, saying: The jurist Abu al-Hasan Sa‘d Allah ibn Nasr ibn al-Dajjaji, and Abu al-Ma‘ali Ahmad ibn ‘Abd al-Ghani ibn Hanifah al-Bajisra’i, both narrated to us, saying: Imam Abu Mansur Muhammad ibn Ahmad ibn ‘Ali al-Muqri, known as al-Khayyat—may Allah have mercy on him—narrated to us, saying: Abu Tahir ‘Abd al-Ghaffar ibn Muhammad ibn Ja‘far ibn Zayd al-Mu’addib narrated to us, reading to him while I was listening, in the first ten days of Dhu al-Hijjah in the year four hundred and twenty-seven, and he affirmed it, saying: Abu ‘Ali Muhammad ibn Ahmad ibn al-Hasan ibn al-Sawwaf narrated to us, reading to him while I was listening, and he affirmed it, saying: Abu ‘Ali Bishr ibn Musa narrated to us, saying:
