Hadith 912

912 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ، قَالَ: ثنا عَبْدُ الْمَلِكِ بْنُ عُمَيْرٍ، قَالَ: سَمِعْتُ عَطِيَّةَ الْقُرَظِيَّ، يَقُولُ: «كُنْتُ يَوْمَ حَكَمَ سَعْدُ بْنُ مُعَاذٍ فِي بَنِي قُرَيْظَةَ غُلَامًا، فَنَظَرُوا إِلَي مُؤْتَزَرِي، فَلَمْ يَجِدُونِي أَنْبَتُّ، فَهَا أَنَا ذَا بَيْنَ أَظْهُرِكُمْ»
Sayyiduna Atiyyah Qarazi (may Allah be pleased with him) narrates: The day Sayyiduna Sa’d bin Mu’adh (may Allah be pleased with him) was appointed as an arbitrator regarding Banu Qurayzah, I was a boy. People examined the area below my navel and there were no pubic hairs grown there, and for this reason, I am present among you.

Explanation & Benefits

Benefit:

➊ The Banu Qurayza had made an agreement with the Muslims that they would not assist the Quraysh of Makkah against the Muslims. However, due to the instigation of Huyayy ibn Akhtab, the chief of Banu Nadir, Ka‘b ibn Asad, the chief of Banu Qurayza, became inclined towards breaking the covenant. The Banu Qurayza, in fact, assisted the disbelievers during the Battle of the Trench (Khandaq) and undertook actions that increased the difficulties for the Muslims. In this way, the tribe of Banu Qurayza became guilty of breaking their covenant.

After the conclusion of the Battle of the Trench, the Messenger of Allah (sallallahu alayhi wa sallam) laid siege to the settlement of Banu Qurayza. Allah, the Exalted, cast terror into their hearts, and they became willing to surrender their weapons and said that whatever decision Sayyiduna Sa‘d ibn Mu‘adh (radi Allahu anhu) would make, they would accept it.

Sayyiduna Sa‘d ibn Mu‘adh (radi Allahu anhu) decided that all the men of Banu Qurayza should be killed, the women and children should be taken captive, and their wealth and property should be distributed among the Muslims. [الرحيق المختوم : 509]

➋ The sign of adulthood is the appearance of pubic hair, or the growth of a beard and mustache.

➌ The prescribed punishment (hadd) is not implemented upon minors; however, an appropriate discretionary punishment (ta‘zir) may be applied.
